Sent off for my 6 years worth of bank statements/charges around Christmas time. They cashed my £10 check and sent acknowledgement saying I sould get info by 12th February.

Never did! Therefore a couple of weeks ago I wrote again asking for the statements within 7 days I would take it to the information commissioner. Still nothing - they're taking the pee now!

    Can anyone suggest anything?

    Hi folks,

I'm reclaiming the charges for my sister, and have had the response back from the data subject access request (near the full 40 day deadline).

Unfortunately what she received back was downright bizarre, not only have HSBC only sent statements for her credit card and not her bank account, the statements that they did send are grossly incomplete, have huge dates missing and even have duplicated pages.

Either the person that sent them is an idiot or the photocopies went slightly mental whilst it was duplicating or something??

So what to do now? The 40 days is already up, we haven't got what we asked for, and they also returned the £10 postal order.

    Any thoughts on next steps??

According to posts I've read about HSBC, if your sister has online banking with them she can access the full 6 years of her account online. Hope this helps :)

    Edited this cos I ran off and got the link just in case she doesnt have online banking. She can register for it here;

    http://www.hsbc.co.uk/1/2/

She will have to wait for the registration details in the post but that will probably be a lot quicker than trying to sort the mess out by any other method. Good luck :)

OK, well I phoned them up and eventually managed to get through to the Data Protection Officer at HSBC (was not easy  ) I asked what they're playing at with these statements, but was told they had no record of having received the DSA request! I was like "Exqueeze me lady?", so to cut the story short I faxed across the original request and the cover letters they sent back (there were 2 of them??).

I just got a phone call saying it was being dealt with in a different department, and that because only a credit card number had been included on the letter that's why there were no bank statements. I quoted part of the letter back to her... "Please supply me with a complete list of transactions and charges relating to my banking history with your organisation".

So what was hard about understanding that? I said that for the credit card statements they did send, there were entire years missing and that many pages were just duplicates. I asked her to arrange for them to be dispatched as soon as possible, but I'm annoyed.

The 40 days is up (deadline expired a few days ago) and was told it could take 2 weeks to get the information to me. What should I do?? I'm just miffed, and keep thinking that *I* should be setting the pace. How can it take a company as big as HSBC a whole 40 days and 2 weeks (like nearly 8 weeks) to simply print information out of a database and send it in the post? It's not my fault they only did half the job in the first place and a half arsed job on the other half anyway.

So what should I do??

  • I contacted my business account manager and requested a list of charges made to my current account over the last 6 years (estimated to be 4 thousand pounds) and enclosed a cheque for 10 pounds.
It has now been 46 days and so Lloyds have made a breech of the data protection act. Has anyone else been in this situation? If you have I would reaaly appreciate it if you could let me know what happened next. I have informed the commissioner and am awaiting a reply.
  • Lloyds have 40 days from the date they receive the letter - not the date you posted it. It is worth ringing them to see if they have it, as I got my statements exactly 40 days from the date they received my letter.

For a start dont get mad , get even. Stress kills !

You asked what the next step was in your last post and I replied telling you HSBC online customers can view their full 6 years records online and I gave the link for her to register for it if she doesnt have online banking already. Take charge and cut out the middle man.

However, it may take two weeks for her registration details (username and password etc) for online banking to come through if she needs to this, sometimes only a few days. If the details turn up in the meantime you will get the information either way so win/win on this particular problem.

Right now just about all you can do is complain to the Information Commissioner about the delay. The banks are receiving thousands of data requests and obviously cant keep up or screw it up and the commissioner in turn is dealing with thousands of complaints about it. You arent the only one. I know that wont make you feel any better but I have suggested an alternate way of you to get the information, its up to you to take it.

    Good luck :)

I am at the first stage of claiming my charges back. I sent my cheque to my bank and it was cashed on 2nd February. On 5th February I received a letter acknowledging receipt and saying they would respond within 40 days as per the Data Protection Act. Yesterday I received a letter from my bank yesterday saying that although the 40 days were almost up they would be unable to comply with my request as this is such a high profile issue and they are unable to handle the demand. They have stated that whilst I am within my rights to go to the Information Commissioner they they will respond as soon as they have got the data.

Should I report this to the Information Commissioner or give them a bit extra time?
