I've just called Egg today as the 40 days was up today, and was told that despite my letter arriving with them 40 days ago, they don't start the process until they recv extra DPA info they asked for. I sent back what they asked for and apparently thats when they start their 40 day clock from. They say they will get the info to me by 19th March!!! I told them thats not good enough. If they want to ask for extra info, thats fine, but does that really give them the right to prolong the process?? Their the only company who asked for extra evidence of who i was.
Should i start the complaints procedure on Monday when back from business trip, or just wait til the 19th???
    Any views appreciated.

  • I made my request to the Halifax for my statments, enclosed the cheque...at 32 days I recived an acknolegment that my request was being looked into...at 38 day I recived a bulky envelope from the bank with 6 years of back dated statments... for the wrong bank account.

After checking a copy of the orignal letter. I had deffinatley asked for my personal account with no other signatory (they had sent the account statments for me and my partner)... What do I do? What is the status?

Do I contact the bank and tell them of their mistake before or after the 40 days have ellapsed (it's getting close)... Can they delay sending the correct statments for another 40 days?
Can any of you guys help.

yes they did that to me too, 3 times even though I pointed out their mistake! Did get the right statements eventually but had to threaten them with reporting them to information commission. There is a letter somewhere on the site that you can send them about not receiving your statements within the timescale. I would phone them now just to make sure they are sending you the right ones
  • Hi guys,

The Lloydstsb do currently have a 2 month delay on bank charges and this is the reason why your cheques are being delayed. If your 40 days are up, CALL them and state its up, your letters that you sent are dated as of when they received them. Be forcefull and say you will get your solicitor involved, this will speed up your process.

May be the same reasons for other banks as so many people are requesting bank charges back.
  • Hello everybody, I'm a newbie, just joined today :j I apologise if I've put this post in the wrong place... wasn't sure... :o

Well, my hubby and I are looking to reclaim charges from Halifax. I've had a good look round but can't seem to find the answer to my question anywhere, so hoping you kind people will answer!

We sent Halifax the first letter asking for a list of all penalty charges levied on the account within the last 6 years, and saying they had 40 days to provide us with it.

It's now been 45 days and all we've had is a letter sent last week telling us 'copies of duplicate statements have been ordered and will be sent under separate cover'. That letter was dated 15/02/07. Should we now be following up with phone calls as they have gone beyond 40 days? If we do ring them, how much longer do we give them before we take further action to get the information?

Eagerly awaiting any replies, with a big thanks for reading xxx

I would check the back end of the Halifax thread for a phone number regarding this as Halifax seems to be sending them out for free via a phone number. Or send the letter in the link above, post 122.

    Morning all.....
well our 40 days is up next wednesday.Phoned Natwest last night , and reminded them that the 40 days will be up , and that they have witheld our rights , and appropriate action will be taken. The guy on the phone couldnt apologise enough , said we'll make no charge and destroy your cheque as a "gesture of goodwill" and will make sure statements sent out today. So we'll see.......

    sam.
:T Thanks to all the comps posters :T

Typical, as soon as I'd posted, I found the letter above (message 122) along with all the other messages with similar problems.

I really must remember to take my brain out of the fridge in the mornings...
