    That would have been useful to have posted in the original post - It's likely ended up with Parcelforce after being sent express USPS from the US - the equivalent to our postal service.

    As its eBay I guess you could do a chargeback, but as its not a UK retailer the seller will lose out and they will need to claim fromt he USPS (or appropriate courier if its not USPS)

    Like I say, the info about eBay and the USA as source really would have been useful in the first post....90% of whats been said no longer applies...

    Ebays rules say that the seller is responsible to ensure delivery to the buyer. If the buyer doesn't receive the items then the seller has to prove delivery. Seller can't prove delivery to buyer. End of.

    This is business. No place for feeling sorry for the buyer and saying it isn't their fault. No it is not their fault, but their contract is with their courier and up to them to claim back from them, and in the meantime it is up to them to refund you.

    As a side note, if you paid with PayPal (which I assume you did as US seller), you're waaaaaaaaaaaaaaaaay better protected as buyer than they are as seller...

    Yes I have put in a refund,I just posted this thread because I actually wanted to know what I can do about my neighbors are they really just going to be allowed to keep it or is there anyway I can go who will make them give it back? Why should I have all the hassle and they just get away with it.weird hugh???

    I'm no lawyer, but I would think that unless it was clearly stated to the people next door that the parcel they were signing for was to be passed to you and they signed to that effect, legally there is no comeback on them. I know it seems mad but there was no theft and there appears to be no written agreement to pass the parcel to you. Such arrangements rely on goodwill, and where there is none, then you have nothing.

    thank you so much,i see what you're saying and it makes sense even though i don't like it and it's immensly frustrating they having summit you paid for,even if i get a refund it'll always be a thor in my side now
    thanks again to all for your trouble to make me understand more,i guess i was just soo shocked there are peeps like that,and i gave him back his chelsea flag that blew into my garden no idea they had my stuff at the time how mean

    the delivery guy actually came back yesterday to retrieve the parcel of them and i heard him say "it was for no 30 *****rd
    She than said "well I havn't got it,my brother took it"
