will my bf lose his licence?

My bf has 11 points on his licence, with 5 due to come off in August.

At the weekend he was driving my car home with me sat beside him when police pulled us over. They said that they had run an insurance check and the vehicle was insured to drive by one driver (correct - me!) My bf said that he had fully comp on his own car which allowed him to drive another vehicle third party. The officer took his details and said that my partners insurance covered him to drive his own vehicle fully comp only therefore was driving mine without insurance. The officer said the fine was £200 and 6 points on his licence, and if I hadn't been in the car they would have impounded it. He has to produce his documents to police station within 7 days.

When he got home he checked his insurance policy and could not find any mention of being able to drive another vehicle third party, so he phoned insurance company to check. They confirmed that he was not insured to drive my car. He is shocked as he genuinly thought that he was insured to drive my and no way would I have let him drive it had I known he was not insured I would have driven it myself!

Where on earth do we go from here? Will he lose his licence? He is self employed so won't be able to work if he does, also he has shared residency of his children, so would not be able to have them as he lives 50 miles away from where they live and would not be able to drive to pick them up, take them too and from school or to their afterschool clubs!

    Sounds like the officer was right, though not sure how he would know the details of your bf's insurance policy.

    It used to be that comp policies always used to cover you to drive other cars you didn't own as a matter of course-but it got so badly abused (buy a cheap to insure car then register the expensive to drive car in the name of another family member) that the insurance companies stopped doing it. I'd guess the policeman knew it didn't work that way anymore and that's how he "knew".

    Don't take this the wrong way but if all these aspects of his life are so important then he should be more careful about accruing speeding points if he's up to eleven already.

    You are trying to play the sympathy card regarding his children but what do you suggest? That he is permitted to simply carry on accruing points with no consequences because he has children that he needs to see? Lots of us have people have children I'm afraid, this doesn't mean that we're allowed twenty or thirty points on our driving licences.

    A determined father will see his children whether he has a car or not.

    You yourself apparently have both a car and a valid driving licence, surely that will enable him to continue to pick them up when he has the children overnight or for the weekend? :)

    Your lucky not to get done for permiting no insurance. Ignerance is no defense. You should of checked his policy before you let him drive your motor. The cop's have been gentle on you cos your a lady.

    When questioned my bf said he had fully comp insurance on his own car and he could drive mine third party and officer asked for reg number of his vehicle and ran it through his computer which is when he came back and said he could drive his own car only therefore had no insurance to drive mine!

    My bf and I don't live together, he lives 50 miles from me and I work full time so no way I would be able to get his kids to school and back and to their clubs

    To be honest, nobody with 11 points on their licence would ever sit in my cars driver's seat, let alone drive it.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    Well I'd be ringing the insurance company now and getting each of you added to each others policies so you can drive each others cars. If he can delay court hearings long enough he'll get the points just as they are coming off although I must admit August is pushing it. Also, if he gets a solicitor to represent him he should be able to claim hardship if he were to lose his licence. It'll cost him quite a bit though.

    Are you serious? I could have been done as well? I knew he had fully comp insurance and every other policy he has had in the past has allowed him to drive my car third party. In fact last insurance was through same company as he had before and he renewed it for another year and I know he had it on his last insurance.

    If he were to lose his licence how long do you think he would lose it for? Just until August until his points come off or longer?
