    If you don't know what your bank's terms are phone them up and ask them as they will pick this up at a later stage if you claim for charges you shouldn't.

    Please help,

    If i'm being charged £20 for going over my overdraft, do I try and claim back the £20 or do I deduct anything from that amount. Let's say a £2 spend made me go over and thus a £20 charge, do I claim the £20 or take £2 off and claim £18???

  • I have received a response to letter 1 listing all charges. Do I claim back the total amount, i.e. if they charge £30 for going over drawn, do I ask for the whole £30 or deduct £12 which I understand in the legally agreed charge.

  • I wonder if anyone can help me. I am not even sure if this is the correct place to post my query. I have never really had a problem with my bank account before, apart from being overdrawn a bit, but within my overdraft limit.

    I am with the Nationwide, last year they changed my normal cash machine and cheque gaurrantee card for a visa debit card, which I was quite happy with, and all was well. Then at Christmas I had a bit of a slip up with my account (money I thought had gone in hadn't), so I went £15 over my overdraft limit, which I found out when I tried to withdrawn money and the hole in the wall told me I couldn't! When I got my bank statement it had a charge of £21 + pence for "credit card misuse"

    Can anyone tell me what that means? Is it because I went over the overdraft, or is it for trying to use my card in the hole in the wall when I was overdrawn? And do you think I could get this money back? I don't even class my card as a credit card, as I can only get money if it is in my account, it's a debit card!

    A card misuse fee is when use use your card and there are not funds in your account to cover the transaction, either at an atm or in a shop. If the card is declined you shouldn't be charged, it is the transaction that puts you overdrawn that generates the charge.

    The charge isn't listed on their rates and charges page for current accounts, so it may be worth trying to get it back. Unfortunately I can't find my terms and conditions booklet so can't check if it is in there.

    £12 is not a legally agreed charge. It was set by the OFT as a maximum charge on credit cards (nothing to do with bank charges). Only a court can decide if this amount is fair or not.

    You claim for the whole £30.

  • Thanks for that, so as I hadn't used the card or a cheque in a shop, and the hole in the wall didn't give me any money, it must have been a cheque I had posted that had sent me over the overdraft.

    I have no idea where my terms and conditions booklet is either!
  • Hi to everyone out there. I posted of the S.A.R on 01/02/07 (recorded delivery) I am doing this on behalf of my son who has been gathering a steady amount of unlawful charges over the last five years. I am already worrying about counting up interest etc and the word spreadsheet gives me nightmares. I hope some of you kind people will help me out when the time comes yours in anticipation :confused::confused::confused:

  • every time I use my Card for ANYTHING including a cashpoint in South Africa, I get charged £1.50. and incredibly every time I order from an international ebay user, or amazon.com I get charged £1.50 per transaction. I don't believe that I was ever told about this, my charges total £112.50 over the last 4 years. is this legal? is it reclaimable? has this question been asked because I cannot find the thread if it has and thus apologize.
