First time poster but am now about to use the moneyclaim process and wanted to get my facts right first.
I'm specifically wondering whether you can claim ANY charges that have appeared on your statement within the last 6 years or just certain charges. For example, my statements contain all of the following charges:
o/d interest
o/d usage fee
unpaid s/o
unpaid d/d
unpaid cheque
o/d excess fee
I think thats all of them!! :rolleyes:
Can I include all of the above on my claim?

List Of Charges We Can Reclaim
The following is a list of Bank charges that we can and cannot claim for. Different banks may have different names for the same type of charge, if you are unsure about a charge, just ask in the board. If anyone has different charges to add, please PM myself or Edinburghlass so we can add them.
CAN BE CLAIMED
Account misuse fee
Cheque return fee
Card misuse fee
Unarranged borrowing fee
Unauthorised overdraft fee
Unpaid DD fee
Unpaid cheque fee
Unpaid standing order fee
Late payment fee (credit cards, store cards, catalogues etc)
Exceeding Authorised Overdraft Limit
Exceeding Unauthorised Overdraft Limit

Hi there
Bank refund newbie here! Was directed here for advice from a friend. We have just recieved our 'yellow pages' 6 yrs worth of statements and going through them we have become a little confused. I understand we can claim the failed cheque, failed direct debits etc, but I've noticed alot of the following back in 2001 on the statements: "Unauthorised daily OD charge, 3 days at £3.50, total £10.50" Can we claim those?
I thought I had fully researched this while waiting the 40 days (actually they took 39 - amazing) for the statements but this has thrown me!!

Could someone tell me please, my bank have charged me £25 for paying an item for me(many times over the years)...sometimes those items are only a few pounds..
can I claim those back also?..does the item have to be a certain amount to justify the £25 charge..
I am in the process of claming my bank charges back, thanks to this wonderful site and all the help I've read here..I was going to put it into someone hands to deal with.."no win no fee"..but have decided against it..

I am sure this has been asked, but if I am charged £40 for bounching a cheque, or going over my overdraft limit. Do I try and claim the £40 or £40 less £12 various consumer groups say they can charge.

You claim for the whole amount. The £12 mentioned is nothing to do with bank accounts. It is the maximum the OFT considers a fair amount for credit card charges.How many surrealists does it take to change a lightbulb?

If I may correct you slightly there, the OFT did not say it was a fair amount for anything. The £12 is the threshold beyond which the OFT will get involved themselves. They stated it is not an indication of what is fair and it is for the courts to decide (if there ever ends up being a proper test case).
Apparently a judge recently deemed £5 to be fair (in the absence of any information on costs being provided by the company) in a case of someone against Egg, but this has not been confirmed.
It is a myth that the OFT said £12 is a fair limit and a lot of banks/credit card companies are using this to offer settlements based on refunding back to £12 per charge.
The law is no different for either types of company, in that they can only claim liquidated losses for breach of contract which in the case of penalty charges would be pennies as it's all automated.
Unless any company actually shows evidence of their costs (which they won't) they have no basis for anything other than a full refund of all charges.0
