Just got my first letter typed up and ready to go.
Im claiming £2900 from rbs and just as i put stamp on my claim letter i panicked.
Could someone please answer this one question: My account has been appalling, reached overdraght, gone over,agrred new o/d went over that etc,etc.
This has gone on for years ,including later and later payments. My point is this could the bank claim a reasonable defence in so much as me not keeping to agreements, going over limits etc.and so this has cost them more to manage my account?
The examples ive seen on your threads all seem to be claiming (and rightly so) for ridiculous charges for going over by one penny, or being late by two days.
To be totally honest my banking has been shocking and would a court possibly find in favour of the bank because of the vastly extra maintenance of my account? Any advice0 -
How your account was conducted is irrelevant.Claims are justified for the following:Account misuse fee
Cheque return fee
Unarranged borrowing fee
Unarranged overdraft fee
Unpaid Direct Debit fee
Unpaid cheque fee
Unpaid standing order fee
Late Payment fee
Exceeding Authorised overdraft fee
Direct Debit/Standing order/Cheque returned fee
Irregular fee
These cannot be claimed:-
Cash machine withdrawal fee
Account service charge
Service fee/Annual fee
Monthly account fees
Foreign currency exchange fees

I downloaded and read that document, and didn't see any mention of maintenance charges.
Some accounts offer a service that you pay a charge for each month. These charges are not claimable.How many surrealists does it take to change a lightbulb?

Just going through my statements and have sorted out the charges that i can claim back. But every month side by side are these two charges: It is the Royal bank of scotland.
INT TO 22 dec A/C********* £26:98
CHG TO 22 dec A/C******** £40:00
I know i cant claim back the interest but what is the charge i get every month and can this be claimed back?

Total charges are reclaimable, they are a separate issue to the other afore mentioned charges (card misuse, returned d-d's etc), and are not simply all of these charges added together each month. So they are also claimable on top of the other charges.
"Total charges" refers to the charge they put on your account for going over your overdraft limit, this charge is calculated daily, and they can charge up to a maximum of £125 in one month for this, it is then debited from your account on a set date every month.

Hi if you see this question on another thread please excuse me but i cant for the life of me remember where i posted it. anyway. can anyone tell me what a cheque holding fee is please. My oh has a number of these on his business account. approx 100.00 a time. He is starting with the reclaim route. At last. Have looked through other threads and have a comprehensive list of what we can and cant claim for but have not come across this type of charge before.
