I have just received notification that my bank has filed a defence against my claim and I now have to fill out the CAQ form, and pay another £100 court fee for the claim to be continued in my local county court.
Has anyone else got to this stage and found themselves in this situation? If yes, can you give me any guidance/tips and tell me what the outcome was?
Also, will I be left with a massive bill if I lose?0 -

I am at exactly the same stage. I have had £750 from Lloyds, and have yesterday received back a defence statement and a questionnaire, along with a £100 bill to pay. And they are contesting also paying me a similar amount. I can't find anyone else though who has already been through this, to pick their brains! If you have followed the instructions, the chances of you losing are very small, and as you're in the Small Claims track, it's is extremely unlikely you would have to pay any costs if you did lose.0 -
I know that I have seen somewhere on this site advice on completing the N149 court allocation questionnaire. Can anyone please point me in the right direction.0

Hi everyone,
I'm trying to claim £800 back from HSBC. After writing to them three times and getting the standard "we are looking into the matter" reply, I issued a claim on MCOL. They have acknowledged the claim after only one day!:eek: I'm getting a bit nervous about it now, as i'm thinking this quick response means they might put in a defence. Oh dear! I can't seem to find details on here of anyone whose case has actually gone to court? Has it all been settled before the hearing stage for everybody even when the bank has put in a defence?
Any replies would be greatly appreciated to put my mind at rest, as i'm doing this on behalf of my brother and I told him it was pretty much a dead cert that he'd get his money back and now i'm feeling rather guilty and worried, especially seeing as I paid the £80 court fee for him!!!!!0 -

You cant find any posts here about cases that have gone into court because there haven't been any. Out of the thousands of posts, this should tell you that your chances are excellent.How many surrealists does it take to change a lightbulb?

Hi guys,
I've filed my claim on MCOL, and it was classed as Issued yesterday. Cap1 have acknowledged it.
I've not seen anything like Manchestman recommends sending (above) before - is sending my list of charges and interest necessary now or later once I have received the AQ?
I enclosed the list of charges in both my prelim and lba letter to Cap1.
