    It is worth sending this letter and a list of charges to the court, and solicitors. This way you have them lodged with your claim. It is good advice.

    Don't send to the solicitor until you receive word back from the court.

    I received the Notice of Acknowledgement today - Cap1 selected the option to defend in full, so now they've got 28 days to proceed.

    First time poster here, may I firstly say thanks for all the advice I've received from this site/forum. It has been a great help and hopefully my unfair charges will be reimbursed soon.

    Just a quick couple of points that I need a bit of advice on:

    - I have gone through the various stages of the process as advised on this site, I got to the Moneyclaim part of the process, submitted a claim and have recently received a copy of the defence papers from Barclays. In their defence, it says "the particulars of claim do not provide details or particulars of the account in question or the precise charges alleged to have been unlawful, or the date thereof". Should I be concerned by this? I have already sent them a full list of the account details, the charges and the dates in the earlier stages of the process so Barclays definitely have this information. Should I include a copy of the charges and the dates when I return the Allocation Questionnaire?

    - My total claim, including the £120 I paid on the Moneyclaim site, is approx £1306. Am I correct in thinking that, as this claim is less than £1500, I do not need to send a £100 payment with my allocation questionnaire?

    Any advice is greatly appreciated. Thanks in advance
  • i have reached the stage in my claim of filling out the allocation questionnaire but have become stuck trying to work out what a pre-action protocol is and whether or not it applies to my claim. does any one know what this means???

    abbey put a defence in for my claim then agreed to settle out of court the same day. i have received the allocations questionnaire from the court today but i am still awaiting the cheque from Abbey, i don't want to cancel the claim with the court until i receive my cheque, is there a time limit to send the allocations questionnaire back?

    You don't need to send the £100 payment, just tick 'No' on that part of the AQ...

    Also, Barclays worded that on their defence of my claim too and they DO have the list of charges etc, so don't worry about that either. It's fairly standard :beer:

    firstly i'd like to thank everyone here, because without all the advice i have had from scanning through the various threads, i would have jumped ship a long time ago.

    Ok, Barclays put in a defence 30 minutes before the end of the time period for my claim, and i have now received an allocation questionaire.

    does anyone have any advice on what to write in the Other information section, apart from listing all the charges and dates. And is there anything that i should definately include?

    Also, in their defence they have stated that they will seek to recover their loss and damage against me. What does that mean or is it used as a method to make me stop my claim here?

    And lastly, sorry about all this, i have to return the questionaire by a certain date. Is this the court date or does that get issued after the questionaire has arrived?
