Which Court ?

  • All claims posted through MCOL have the default court of Northampton. Presumably if it goes to the lengths of setting a court date you can have it moved to your local court. :D

    Hi,

    I am up to the letter 5 stage of reclaming my bank charges, I need to send this off tomorrow, but on the letter it says " insert name of court" I am not sure what to put in here as I do not know which court it will be yet, do i just put in here the small claims court ?

    thanks
  • The bit where it says:

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour

    What do I put in the inset name of court bit?I'm claiming around £4100 (eek) and I would lodge my claim through MoneyClaim - but what do I put in that field? My local Small Claims court or......what?
  • Righto - now I'm even more confused. At the start of this thread it says to put your local county court. And at the end it says put some court in Northampton....?

    Is one definitive answer? Which one is it! Please help!:o

    You put your local county court.

    The reason Northampton is mentioned is because all the moneyclaim online cases start there. They are always transfered to your local county court if the bank enters a defence.

  • Hi, wonder if someone can help me. I am at the stage in my claim where Barclays have said they will offer me half the money I am claiming and I am sending the standard letter saying "See you in Court"!! but it leaves a blank for the name of the court - is this my local court or what should I put here.

    Any help gratefully received - wished I had been one of the lucky ones that just got the cheque but Barclays seem to be digging their heels in.

    Want to battle it out but could do with a bit of support and help guys.

    :confused::confused:

  • Either leave that bit out or put in your local County Court.
