    The first letter is asking for all statements which I have.

    The letter I wish to write is the one asking for payment of the charges back.

    Regarding the first reply, I do know what i am letting myself in for, but to be charged near on £3.5 in under 1.5 years is very excessive.

    Even in the second one, where do I found out where my local court is?

    If your first letter asking for the return of charges mentions a court. You are using the wrong template.

    When you need it, you can find your local county court in post #6 of THIS THREAD

    I was using the incorrect letter. But this link will be usefull if I don't get the correct response which will be very likely I would imagine.
  • Hi everyone, on the sample letter threatening to take the bank to court what is the name of the court????? Is it the small claims court or is it your local court e.g. Cardiff court. Also I'm a bit concerned about the credit card and overdraft I have with the bank. will they just take it away, when they close my account. Cheers everyone :confused:

  • Some banks are closing accounts, there is more on the "closed accounts" thread on this board. They might use the money to pay off the overdraft and credit card, they did that to my mum but she was happy as it meant one less debt to pay.

    Not sure about the court bit - I used a template available on Consumer Action Group and all it says is I will take you to court. If you're using MCOL, I think the default court is Northampton.. It's probably enough just to state you will pursue a claim against them through the courts without mentioning which court.

    I had a similar question when coming to fill in the template letter but eventually just put court as I thought no need to name the court at this time as I was only letting the bank know that I would go that far.

    You can either leave that bit out of the letter or put in your local court if you know the name, as you say Cardiff.

    All banks can, and some do close accounts and call in overdrafts so you do have to be aware this may happen. Your credit card should be a different agreement.

    I am very new to having to deal with anything like a court, as many of you i have no doubt are . However when i was filling out the letter it said which court?. do i put my towns magistrates court, small claims court ect. Any help greatfully recieved.

    but it doesnt seem to be there im in scotland
