  • hi all. ive been fighting to get my charges back since the begining of feb 2007. i was with the woolwich bank who have recently been taken over by barclays. subsequently my claim has been taken over by them. which i do feel is wrong because i never have and never will have an account with them. they have been fobbing me of for months now and last friday we went to court and they applied for a stay on the case because of the oft test case. Now i have a bit of a dilema because im not sure wether to appeal agaist the stay or not. can anyone help or is anyone else in this boat... the woowich applied these charges not barclays...

    Without knowing the level of judge who made the order I am not sure whether you should appeal. If the order was made by the district judge then I am more inclined to say appeal than if the order was by the circuit judge. The reason is to do with who would hear the appeal. An appeal from the district judge goes to the circuit judge at the same and does not create a precedent so would cause limited problems. An appeal from the circuit judge goes to the nearest High Court Appeals Centre depending on where you live. It is the posssibilty of creating a precedent here that worries me as any decision would bind the county courts so if you are unsuccessful the banks would have a decision on stays which they could use.


    On the actual point I think the judge was wrong as Barclays and Woolwich are legally two different people so Woolwich should have made the application. My company law is extremely rusty so I am not sure if the parent company can act for its subsidiary and have grave doubts that it can.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    Good Morning, I'm wondering if anyone can help me. I've printed off the template letter to ask Barclays for charges on current account. I'm also going to ask Woolwich for charges to my mortgage account. But I don't know where I post these. Do I just send them to my local branch or is there somewhere else they have to go to. Also what are the chances of Barclays closing my account only I cannot open account because I have a CCJ against my name. So Halifax wouldn't give me an account. I've decided not to ask for interest I just would like them to offer me something. I'm not very brave when it comes to fighting.
    Please any advice would be greatly received. Thanks very much
  • Hi I hope someone can give me some advice....I am helping my partner claim back his bank charges from a Woolwich Open Plan account that he had for about 12 years. This year they were taken over by Barcleys and he moved to LloydsTSB (for several reasons) Now he wants to reclaim his charges who does he address his letter to? Would it be Barcleys or Open Plan Woolwich? There is a address for Woolwich on the forum but I wanted to check first.

    I wonder if anyone can help me please - it would be very much appreciated - my problem is this - I would like to make a claim to reclaim bank charges... BUT I am with the woolwich - well was with the Woolwich before they were taken over by Barclays... As I was with the Woolwich for many years it is to them that I need to make the reclaim for bank charges to - what do I do ? do I make the claim to the Woolwich (who no longer exist??) or to Barclays - Im confused - pls help if you are able to.   • the woolich still does exist...if you go into any barclays branch any teller will tell you who to contact...dont forget you dont use your existing new account number with barclays...but the woolich account number you had! records will still be held but in my estimate you are now going to be claiming against Barclays as they are now the owners.

  • Hi Guys
    Wish I had the addresses earlier as I and the courts have been sending everything through the Woolwich Bexleyheath address.
    Courts ruled on my case and awarded me all charges but yesterday received noitice of application to set judgement aside and vary an order of 12 July on grounds Barclays did not receive July notice until 7th September. This came on the day i was about to set off and serve a winding up order on Barclays. The court have set a hearing date for 7th December 2007. I am now getting really peeved having laid out £280 in court costs to date. :mad:

    I am currently composing response and request for dismissal of both set aside and variation using all the usual arguements re hardship, human rights, defendants conduct etc.
    Anyone know how many cases have been taken against Woolwich or how much they have settled to date? Need this for case of precedence.

    Hi,
    can someone advise me on who I should contact with regard to loads of charges that were applied to my account with the woolwich, as they have now been taken over by Barclays.
    Should I write to Barclay's requesting 6 years worth of info, even though i have only banked with them for a couple of months (since they took over)?

    I looked at claiming the charges before xmas, and worked out then that they totaled over £2000 and that was just for the previous year.

    My other query is whether the fact that i pursued this with them and they refunded some of the charges will affect a future claim (for the outstanding amount)?
