    Well I telephoned them this morning, offered to negotiate and they said "no". Pointed out that I was prepared to take this to court and would be claiming the full amount plus stat. interest plus court fee and they said "no". Said they wouldn't be offering any more as they had already offered 75% of what I was claiming (this is apparently the maximum they will pay out). So off to court I go! It's money I thought was gone so I'm prepared to wait for it!

    I made a phone call this morning to Barclays (former Woolwich) whiched had previously offered £1024 as a gesture of goodwill for my £1876 claim of which I declined and proceeded on with money claim, on 14th acknowledge and further 14 days entered a defence. Still waiting for court date to come though. But after hearing about yesterday’s events with tsb in court, decided to take the offer (cut and run).
    But after making the phone call this morning to accept the offer, was told this would now continue to go to court due to yesterdays events of the bank winning.
    Thought you guys might find this interesting.

    Hi....thats dissappointing, I have just returned my offer accepting as part payment or offering to settle without interest. What do you think will happen next?....Surely that judges decision cant influence every case from hereonin? I guess we will have to wait and see!

    has anybody had the full amount owed repaid by Woolwich or is everyone just getting 75%?

  • Hi I have been following the advice on here about reclaiming charges from the Woolwich. I had the standard letters everyone seems to have had and last week sent them the third letter (the fist asked for a list of charges, the second a refund of the charges) requesting a full refund within 7 days or I would be filing in court. The 7 days is up today and I really can't afford to pay court costs up front. The Woolwich haven't responded (they seem to think they can work at their own speed and not mine). Any suggestions? Do I wait until we get wages and then file or shall I phone to find out what's happening and give them one last chance before filing? I'm a bit concerned having heard that Lloyds won their court case.

    Hi,

    I'd give them a call and then wait until you can pay the court fee. To be honest, there is an awful lot of waiting around involved in this process and they might even surprise you whilst you're waiting for your wages (yeah, right)

    Don't worry about the Loyds case, it was an anomaly

    I have had a 75% offer from the Woolwich. I decided to accept due to my personal circumstances. I got £3,682.00 from a claim of £4,911.00. People on here seem to be getting a little greedy. The Woolwich are not negotiating anymore and are gladly telling people to take them to court. I didn't want to get bogged down in the system and if it goes belly up I didn't want to end up with nothing. Think of how much you have gianed and not the 25% you have lost. If more banks start winning everyone in the court system will start wishing they had taken the money. When I sopke to an adviser at the Woolwich he told me that one man said after accepting his offer "Thanks very much, it's like having a tax-free savings account that you collect after 6 years!" The banks are being polite while they have to be but everyone beware - we all know they will win in the end. Take your money and run!!

    Today I have my allocation questionnaire from the Woolwich.

    I am peeved that a lot of people have been offered 75 percent of their claim, when my final offer was £2000 on a sum of £4800. That's less than 50 percent.

    I have posted before about contacting them and negotiating b4 court, as this has been going on too long now, and I will accept 75 percent. There are too many posts on here making me nervous regarding the banks winning in the end!! Lol

    Would you try and negotiate before court, just in case you lost?
    Can anyone give me a phone number for woolwich or barclays, not sure who to call?

    Just curious to know if the amount you claimed was with or without interest? I'm just about to start the procedure myself, so was wondering if it was worth claiming WITH interest - as I reckon 75% of that amount would be more or less what I'm claiming without...:confused:

    Don't let them Estimate! Gave Powergen a 'real reading' & got £122.16 back that I'd overpaid!
    Mortgage Exit fee - £100 received from the Halifax - for just a phone call!
    Woolwich - received £3,845 refund of bank charges :)

    In my case it's not that I'm being a little greedy. For me it is down to my circumstances - and also this is a matter of principle. I have been prepared to negotiate with them and have offered to settle for less than the full amount they have charged me as I believe I should have paid something in the form of a penalty for each time I went overdrawn, a DD was rejected due to insufficient funds etc. The bank has declined my offer of negotiation therefore I am taking them to court. I have though given them a further 14 days to reconsider their position and again giving them the opportunity to settle for the lower amount. The law is clear on the issue of imposing penalty charges i.e. they should reflect the actual costs to the bank. It is clear from the law, and from how many people are being refunded by the banks that they have been severely overcharged. If it actually cost the Banks £30-35 a pop for each transaction then I'm sure they'd be only too happy to stand up in a court and justify their fees - but it doesn't - and they won't. Everyone's personal circumstances differ and whilst some people may feel able to accept an offer of 75% (or less in some cases) other people will want to hold out for a higher amount.
