"He might have decided that, whilst he would not get his full inheritance as a result, he should get something quickly if the house were to be sold at auction."

Yes,but he's told us he expects a minimum of 170k for his share....he seriously thinks it's reasonable for us to sell if for say, 250k,so he gets 170 and we gets what's left after fees etc....he can't understand why we aren't happy with that deal!

Have you aired the possibility of renting the house out until the house is sold to your waste of an ex? That way he can move in with the skirt and you should get more of the mortage payments covered hopefully... I really can't see how he can force the sale if the house is already on the market for less than other properties in the same area/condition/etc...
That or he can start paying market value for the property to have his half of the mortgage deducted from it :) Bet that comes to more than £300 pcm ;)

I am not a lawyer and it seems you need one - go to your local CAB.

I take it that your mother-in-law has died rather than merely having somehow fallen silent?

What legacy the oaf may reasonably expect may depend on the terms of the will or on the intestacy rules; if there was no surviving spouse but the deceased had children then, in the absence of a valid will, the estate should go to the children in equal shares.

Perhaps kick him out and rent it out to someone until it's sold?
I'm not good at this, but I'd be focusing on getting the scumbag and 'skirt' out of the house :D

That's ridiculous! The house should be sold, all fees etc paid and then what's left should be split equally.

A similar thing happened with a friend of mine, her mother died and in her will the house was to be split 3 ways between my friend and her 2 aunties. When the house was sold the 2 aunties expected to get a third of the selling price each and thought my friend should pay all the fees etc out of her share!

Which was - of course - quite absurd as the fees etc would have to be defrayed from the estate as a whole.

In one way, it was a pity that your friend's mother's will had been found and proved, as she would certainly have inherited more under the intestacy rules.

Its been on since August last year we've not had any viewers. Can he force me to sell it for less than its worth?
I've reasonably asked him to sort the estate agents out & give them a kick up the !!!! or sort another one out as im in hospital & he's done nothing to get the house sold so far. I've done all the legwork up to now & tried desperately to get it sold Ive put it on with 2 agents, arranged their viewing etc & hes done nothing.
Would a court take this into account?x

Hello im sorry you are having bother with this and you are not alone by a long stretch believe me. Now I know this is not what you want to hear BUT this is the sad reality of the situation, the house is not "worth" what you think it is. If it was it would have sold. What a house is worth can go up and can go down it can and does change constantly and what it was worth when you bought it or even when it was valued two years ago is im afraid now irrelevant.

Have you considered putting it up for auction? The advantage is that you WILL sell it and can put this all behind you and also you WILL get what it is worth because of market forces, if it was worth much more someone else would have bid that little bit more to get it the fact nobody bids more means you get what it is in fact "worth"?

A very old but succesful estate agent once told me to reduce the price by 10k a month, at a point you will hit the 'price' buyers become interested.

It's only worth what somebody is willing to pay for it. It sounds like he wants to reduce the price to a level somebody is willing to pay for it, which would be wise if you are serious about selling.
