    Indeed, but on asking myself "qui bono?", it seemed to me that unless his Cunning Plan is for his current receptacle to buy the house - or unless he has a friend he has convinced to buy the house - he will lose significantly from its sale.

    One hardly needs to be Marcus Tullius Cicero to appreciate that someone seeking a change to their apparent detriment seems rather odd.

    Hi Guys thanks for all your responses, I had 4 estate agents & a surveyor go to the house, even the surveyor valued it higher than what its on the market for currently so I guess he has nowhere to go with his claims that I'm overvaluing it...x

    Being reading about your problems and really feel sorry for you. Glad the house is priced right - I would suggest getting more than one estate agent to market it. The house Im renting has been up for sale for over a year and weve just had the 2nd person come to view it today. It does take time. Can you ex not move out completly into his tramps place? This would leave you free to rent it. At least that would give you some income. Good luck! And look after bump!

    All our opinions aren't really useful as this is quite a complex legal situation and only the law will determine the outcome.
    Are you able to get legal aid, and file for divorce?

    Secondly can I suggest you go to the CAB to get their advice.

    This forum is (generally) full of well meaning people who wish you well but we are not experts. The CAB should be able to help.

    I strongly believe the house is priced correctly, the marketing was very shoddy by my previous agents, today I found out that a friend of a friend enquired about viewing the property back in December but despite calling the agents office twice was not called back! The property did not appear on Rightmove either or on the internet anywhere else!
    I also discovered from doing a little research on the net that the 2 houses next door sold last year for 38k & 42k respectively higher than the current asking price on my property, these properties are exactly the same as mine.
    Unfortunately letting is not an option as the valuation has decreased so much it means that I no longer own the required 30% equity to get permission to let through my mortgage company.
    Babys due in a few weeks & its stressing me so much, the ex was screaming down the phone at me again this morning.
    Hopefully Decree Nisi will be granted next Wednesday then just 6 more weeks & ill (kinda) be free of the [EMAIL="b@stard"]b@stard[/EMAIL]!
    I cant get legal aid either as although Im only getting stat mat pay now I earned too much last year to qualify, oh well must keep plodding on, doing it all for my baby girl x

    londonpride. i think the issue is the getting back of the deposit money that the OP put in. It maybe OP that you will have to accept that you won't get all of your deposit back in the current market....Have you talked to the CAB about it yet?

    Morning, I have been in a similar situation and was paying the mortgage on a house that wasnt selling, the valuation was £220k and the mortgage £160k, but for peace of mind and my own mental state I accepted an offer for £191k. It was the best thing I ever did for the following reasons.

    1. No worries about an empty house 200 miles away
    2. No council tax / mortgage / bills and maintenance to worry about.
    3. Ex wife got all the money but good luck to her, its only money
    4. I can now put extra money towards my debts and start saving for a place that will be my own (again)

    Hi Chev,

    I fully understand that I wont get the deposit money back, I just need enough to cover the mortgage & selling fees.
    Its on for sale now for just enough to cover these.
    Its on for 60k less than the original valuation & 15k less than the surveyor valued at.
    My ex is trying to force me to sell the house for less than this so I would end up having to pay to sell my house.
    I have no idea how he intends to enforce the sale? Perhaps drag someone off the street & force them to buy it?
    Nobody has even looked at it. I am hoping when it goes on with a new agent this week there may be some interest.
