Just got the letter from MCR regarding my 3 year warranty.
When I purchased the car in September 2010 I did an HPI check. It came up with "Unit Stocking" finance on it. I was told by the HPI company as long as I get an letter from AQ stating that the finance will be cleared within a couple of days after buying the car. I should be ok to proceed to purchase the car. When I mentioned the results of my HPI check when I viewed the car they told me they will provide me an letter stating this. I didn't have to ask for it.
Im worried did AQ actually pay off the finance on the car? I got the details of the leasing company so I will ring them on Monday just be in the safe side.
When i purchased the car I paid the entire cost via my First Direct Credit Card and arranged for a personal loan with Tesco Personal Finance to settle the balance on the card. Thus transferring the debt to the personal loan.
I take it its First Direct I need to chase up to get the money back on my warranty on the car? I did ring them but they told me to claim of the administrators but reading the guide on here. There little chance of getting any money off them.
Anyway im going to wait until Monday just to check of the outstanding finance that I found when I purchased the car is actually cleared. If is then I will call First Direct again and politely ask for the warranty cash to to be refunded to me. What should I do if the outstanding finance is not cleared? My understanding Unit Stocking finance is used by car dealers to stock their cars up and they are used for short term finance ie 60 days. Afterwhich the car is sold at an auction if the dealer doesnt sell the car after the alloted finance period. Is this all correct?
On the warranty I think I claimed about £400 quid off it so it nearly paid itself off but I still want it back
The way autoquake purchases most of its cars are through unit stocking loans as opposed to paying for them outright. so as soon as somebody pays for the vehicle that loan is cleared within 24 hours, if you HPI your car again im sure its clear. some main dealers do this when they know the vehicle will be in stock for no more than 30 days due to its popularity.
The reason this company went bust is because of arrogant sales managers who are so self assured with their "contacts" along with even more arrogant executive vice presidents and product developmental managers who like adding more fancy words to their titles every week.
Add to that only a small amount of motor trade experience and only £250 to spend on each car for repairs/bodywork, along with hiring some of the most useless mechanics/inspectors who cant (and im a witness to this) change a headlight bulb from a bmw 3 series in less than 40 minutes. The company had potential but all the management loved to do was blow hot air up each others a****s and just sit down on their laptops barking orders looking important oh and lending cars to Whatcar magazine so they get a good review.0 -
Im gonna ring the Leasing company that car was financed on. Hopefully its cleared. First Direct told me to go to the administrators to get my cash back for the warranty off them. But im not hopeful I get nowt from them. I paid for my car inc the warranty on my First Direct Credit card. So I should be covered by section 75 CCA. Im gonna call them again on Monday when I confirm that the hpi is clear.0

I like a few other unfortunate people took out a 3 year warranty and breakdown. I took it out in October last year.
Got my letter this morning and I was digging around and found a pdf of their warranty booklet. If you google search autoquake and warranty it will come up.

Your Autoquake.com Warranty and, where applicable, Autoquake roadside
assistance and recovery, provided by Autoquake.com (hereinafter known as ‘we’,
‘us’, ‘our’) who sold you your car, has been designed to make sure that you get
the most from your motoring with minimum inconvenience.
These services are administered by Autoquake.com Warranty administration
services, a trading name of Car Care Plan Limited (hereinafter known as the
administrator). Car Care Plan is Europe’s leading warranty administration
specialist, and you will receive a first class administration service that is always
reliable and handles claims quickly and efficiently.
This handbook explains how the programme works and the many benefits you
now enjoy as a customer. Always keep this handbook in your car, as you will
need it to make a claim.
Please ensure you fully understand the terms and conditions relating to the
Warranty, Roadside Assistance and Recovery.
This seems to me that the warranty part is separate from Autoquake.com as a trading name of Car Care Plan Ltd. Who are still trading but do not want to honour the remaining terms of the warranty. Regardless of who the funding of the scheme worked in the background to me they are the ones providing the warranty.
I called them and they told me that the money for the warranty had been paid back to the administrators. Which goes with what another post said about them being self insured and had maybe lodge a fund with Car Care Plan with the administrators have then clawed back to pay wages etc along with other assets.
The last page of the document contains this. I will be contacting them on Monday to see if they can offer anyone who has a warranty & breakdown like myself with any form of assistance.

Interesting, a bit of Googling has come up with this:What our promise means to youprotected claims fund, for as long as funds remain in place.
5.1 The product literature will clearly state that the product is a non-insured product.
5.2 Claims funds are protected by a trust, statutory trust or similar mechanism to protect
claims funds for the payment of claims. The product literature will clearly state that a
protected claims fund is in place.

It seems a little ambiguous to me where 5.2 states funds are protected and then 5.3 clearly mentions 'for as long as funds are in place'.

Thanks BodgeP01, that's really helpful. I've got my hardcopy warranty booklet and it says the same thing (pages 4 and 12). Would be great if you could tell us how you get on when you contact the Motor Industry Code Advisory and Conciliation Service. If there is a separate trust fund in place, as there should be according to Robam's Googling, then we may be OK after all (the administrators wouldn't necessarily be aware of this).0

You guys are good at digging stuff up - thanks
At least there's now a couple more avenues to explore other than the [no hope] unsecured creditor route
thanks again guys0 -
Useful information, let us know how you get on. Im not hopeful so i will be contacting my CC provider to arrange for my warranty to be refunded. Via section 75 of CCA0

i also took out a 2 year warranty in september 2010 when buying my car from autoquake. On the 7th of march i had a break down (waterpump failed) i rang the recovery number in the warranty booklet and the car was recovered to a local garage. Carcare plan agreed to cover the repair and sent a new waterpump to the garage, but because they wernt an approved repairer ,I had to pay for the labour and they agreed to send the cost directly to my back account (on the 11th march). As yet no money has gone into my account. The company went into administration on the 17th, so surely they cant with hold the payment.
Also,,i had the warranty cost added to a 4 year finance agreement, so technically I havent even paid for it fully yet. Im wondering if i have any comeback from the finance company.0 -

this is correct but unfortunately the funds that where in place have been paid back to MCR the administrator company. Ive just clarified this with carcare plan. Basicly the warranty is now useless.
Ive spoken to the finance company I bought the car through and they have told me they will give me a partial refund or honour the warranty, someone will get back to me. Of course this doesnt apply to anyone who self funded their car purchase with cash or a loan they arranged themselves, i used autoquake to arrange the finance, so it seems (fingers crossed) i have comeback.0 -
For what it's worth, I had no problem at all with my treatment during the buying process. I was seen about 20 minutes late, but was advised of this, got free coffee and a perfectly comfortable waiting room. Staff courteous and knowledgeable; they asked me about warranty/finance/GAP insurance but there was no hard sell. I took the warranty because it seemed reasonable value and I thought it was offered by Car Care Plan - I'm slightly peeved about that but it's hardly the salespeople's fault!
For others in the same position as me: I'm drafting a letter to my bank about Visa chargeback. Let me know if you'd like to use it to help draft yours (I know there's a template on the site, but I don't think it quite covers the complexity of our situation). I'll keep you informed of progress - fingers crossed at least some of us get success!
Hi there, I have PM'd you, I would be massively greatful if I can get a copy of this letter please as I am in the same position!0
