I agree & if I could go to Visa I would do as the easiest route!
I don't hold out much hope but to me there is something about this whole 'protected fund' that has disappeared that doesn't sound right.
I have to agree with you on this one. Im not hopeful about this protected fund stuff. I'll be calling my credit card company tomorrow (First Direct) to arrange a claim via Section 75 CCA. Im not going to bother filling in that form that the administrator sent to me as there 0% chance of getting my cash back.0 -

I also purchased a car form autoquake in 06/2010, which i'm more than happy with.
However i did also buy a 3 year warranty, which is now void. As autoquake arranged for me to pay this back over a loan does Section 75 CCA apply.
The reason why i'm confused is because on page about section 75 refunds it states that some loans are and some aren't; the catch being "Debtor-Creditor-Supplier agreement"

I'm on the case with Santander, let's see how they deal with the S75 CCA 74 issue!
On another point, during the setting up of the Direct Debit/ loan paperwork, I specifically asked for the DD to leave my account on the first of each month, Autoquake don't seem to have got this right either, the DD is due to leave my account mid month, and Santaner want to charge me £25.00 to change this date!
Anyway, I've been instructed by the call center at Santaner to email my queries to them, lets see how they deal with or wriggle out of these 2 issues.
I am going to post their replies here, only editing personal information.

Here's the letter I drafted. In the end I had to cut it down quite a lot as I sent it by my bank's secure messaging system, which has a limit of 1000 characters. Hope it's useful.
Dear Sir/Madam
Visa debit card number: 4XXX XXXX XXXX XXXX
On 21 December 2010 I made a payment to Autoquake Ltd with my Visa debit card for £7741.30 (the transaction is recorded as taking place on 22 December 2010 on my account). This was for the outstanding balance on a car I purchased from this company (£6902.30), and for a three-year warranty and roadside assistance for that car (£839.00), commencing on 28 December 2010.
On 24 March 2011, I received a letter from the joint administrators of Autoquake Ltd, advising me that the company had been put into administration on 17 March 2011, and that the company was now unable to make any payment or provide any benefit in kind to me under the three-year warranty and roadside assistance.
I am therefore writing to request that under the Visa chargeback rules, you reimburse me to the value of £839.00 for the warranty which I purchased, which now cannot be fulfilled.
I have a variety of documents in my possession confirming this situation, including the letter from the joint administrators, an invoice from Autoquake Ltd detailing the breakdown of the costs of the car and the warranty, and a receipt from Autoquake Ltd confirming payment. Please could you advise whether you would like copies of these documents, either by e-mail or in hardcopy, and let me know the address I should send these to.
I look forward to a full and prompt response to this letter within 14 days.

unfortunatly the retailer (autoquake) cannot tell any lender which day to take the money (i dont know exactly why) it always is 30 days from the invoice date (carlyle is 60 days because they work slightly differently) there shouldnt be a charge they usually change it for the following month fairly easy.

Can you please send in all the relevant documentation in relation to the purchase of the vehicle (copies are fine). This is to include the administration notice to proved the merchant have ceased trading and the warrenty documents. We can then make a decision if you have a valid claim under Section 75 of the consumer credit act of 1974.0 -

The warranty has gone for everyone no matter how they paid
Some may get money back easier than others
Those that paid with credit cards & finance should sort it fairly painlessly
Those that used debit cards may have some chance, but as you feared, I don't think you have much hope with bank transfers but may as well fill in the creditors form anyway
I was a debit card customer but it was over 120 days ago so I'm not sure how the bank are going to interpret the rules for Visa chargeback so I may well be in the same boat as you0
