    It should be 120 days from when you became aware of the issue

    As it's not a legal requirement though, who knows what they'll do/say
    Try asking them for a copy of the rules to read

    Thanks for that, I whacked Santander an extract on the dates and "becoming aware" and await a reply. I suspect the second reply was a fob-off as it was another "service" agent. hope so anyway. Next will be a copy of the rules

    I'll let you know how I get on

    Just got this from Smile [along with the refund]

    Thank you for your recent correspondence regarding the payment for £659.00 to Autoquake.

    Under VISA rules we can only charge back the payment for the outstanding service that you will not receive, as the merchant only ceased trading on March the 17th we have actioned a refund for 580.16 and you will be able to see this on line.

    At the moment, it's all sorted out but if the retailer comes back to me with any further information proving the transaction may be genuine, I'll need to get in touch with you again.

    Sorry for any problems this might have caused.



    For the record: I paid for mine on Nov 5th 2010 so the 120 days after you became aware of the problem rather than after paying in the first place certainly seems to be the rule [with Smile, at least]

    Glad to see it's worked out for you hopefully as my case appears similar I should get a similar result in the end. Having challenged Cahoots (Santander) rejection as bring out of time they now tell me it has now been sent to the Visa chargeback department which sounds more promising. Time will tell!

    I got the whole lot refunded, but I only got the car at the end of December so it wouldn't have been much less if it had been pro rata. Of course, I also therefore made the claim within 120 days of purchase, so that may be significant.

    An update on my situation, I have had the finance company (Close Motor Finance) refund the £839 and monthly adjustments amended. Result. Apart from the fact the car is now out of warranty of course...

    Good to see so many are getting results.

    I too have just received a Visa Debit chargeback of £499 from Cahoot (Santander) which was the full amount for the 2 year Warranty so better than the expected pro-rata (purchased 10/12/10 administration 17/3/11)

    Thanks to the forum and all those who posted for their help

    After going round the houses somewhat (alot) I have also had success.

    Initially I bought my warranty through the finance option offered by autoquake. At first I was worried whether section 75 of the consumer credit act would apply to me as its not a credit card, but it being a 'point of sale loan' came up trumps.

    The finance company first of all told me point blank that the warranty was not void, which I foolishly believed. A bit later I decided to check and it wasn't.

    The finance company secondly told me that I had an obligation to go through Autoquakes administrators, which I foolishly believed. After two months waiting I decided to re-read the section 75 page and it turns out I didnt need to go through the administrators.

    So I continued to chase, but unfortunately the only person who could deal with it doesn't work the exact days I ring, and no one knew his email address.

    ...several days of non-stop hounding during lunch breaks and just before the 5pm cut off...

    And I have my new warranty supplied by a reputable 3rd party, who will hopefully not go into administration.

    I am glad I've got this stage sorted out, and that I know the exact person at the finance company to speak to. So now all I have to do is pester him about the fact my warranty came with breakdown cover (can't do any harm to try).

    Hopefully this will be useful for anyone who bought through Autoquakes finance option.

    I bought the car.

    paid 60% as deposit
    Financed 40%

    Now I discovered that the paperwork for my finance was never filed with Carlyle. The car belongs to Autoquake and I have no idea of what is going to happen.

    I received a call from MCR requesting full payment of the outstanding balance. They said they have sent a letter but i've moved houses a month ago and was not awere of it.

    Does anyone have a similar case? If so, how are you sorting this out? I have been told (by MCR) that a repossesion is not possible due to the fact that I have already paid more than 50% of it.

    Well I am lost. Any help would be appreciated
