    The goods can be assumed to have been faulty when sold according to soga when less than 6 months have passed.
    That is the default position.
    The retailer has the right to prove that the item was not faulty at the point of sale, if he considers it appropriate.

    ...Aldi (as do most companies) have trade agreements in place where the manufacturer takes ownership of the fault.
    Is that a fact, or your opinion?

    Yes I think you are.

    The OP states:
    The manager refused saying that as the pan was more than 30 days old I should take up my complaint with the manufacturer.

    It says nothing about the OP being told that there is a special number to call and if they use it, they will get a replacement.

    Aldi products normally all come with better warranties than the equivalent UK type companies. It is normally the case of phone a number and they will replace it straight away.

    Yes the SOGA means aldi can be held liable but is it really worth the hassle when by phoning a number you'd have a replacement within days.

    Some people just like being awquard.

    Why would they replace after a phone call?
    What proof do THEY have, that there's a problem with the product?
    They will want to examine it for themselves, for verification.

    Don't deal with the manufacturer direct, you will pay postage (cast iron). The product goes to Aldi, and it is their responsibilty to return it to the manufacturer.

    This isn't really anything to do with consumer law, but why did you buy a enamel Cast Iron pan?
    They don't last as long, the damage can be caused by the user using improper tools and just why?

    I love cast iron, I get to season them every year and food always tastes so much better and I can't fathom buying anything other than cast iron. But Enamel really defeats the purpose of cast Iron as you can't use it as a high a temperature as proper cast iron or even the ability to stop sticking. (And if you do use it like a cast iron pan you will cause damage to it, (like blistering and chipping of enamel))

    You mean the enamelled cast iron casserole dish we received as a wedding present 44 years ago was a mistake?

    I'll go and dump it on the givers grave!!!

    If standing up for your rights is 'being awquard' (it's awkward by the way) then I plead guilty. If rolling over and taking the easy option ie. not confronting those that would do you down, then that may be your preferred option but not mine.

    3 times in this tread people have said the retailer gets the choice to refund replace or repair, THEY DONT the consumer gets to choose, the retailer can only REFUSE a choice if it would be disproportionate to another remedy - please note that in the SOGA disproportionate is not quantified as either a value or time, so could mean many things - also, whichever remedy is decided upon it must not cause the consumer significant inconvenience.

    I wish all those giving wrong advice would actually go and read the SOGA before posting, instead of just repeating what they have heard over and over again on here, that has proven to be wrong time and time again!!
