Stick to your schedule, dont give them an inch, if you ask me they will take a mile.
If your LBA stated that in 7 days you will proceed with court action and they dont reply with an offer of a full refund, proceed with your threatened action
Im going through the same process i know how frustrating it is, considering some people on here got instantly refunded of their money, it makes me think if something else is going on, kind of a case by case checking to see if they think your the sort of customer to back down for example.

hi all, goodto read the stories, i sent my 1st letter off last week, 2 accounts and just under £900. I had letter back yesterday saying sorry i had cause to complain, a reply will be sent within 10 days. I had also phoned them to ask for statements, sent without charge. I have banked with them for 12 yearsand last month rang to complain about the charges and said i had had !!they asked me to hang on for statements and they would see what they 'as a company' could do to help as they didnt want to lose m custom!!!! :rotfl: Is this just patter? please keep posting about your progress - i'd love to hear that people are getting money back afte r1st letter!!!:T0

About to send my 3rd letter to FD threatening court action. The 10 days has been and gone (incl Christmas) so here goes.

not sure if this will help anyone but i reclaimed my bank charges from first direct without having to write to them - i just contacted them through internet banking.0

Alright peeps, need some advice. Sent FD the initial letter of court threats etc for the past 3 years of harsh charges they've inflicted upon my account. This totalled £2080.00 They sent me a letter back about 2 days later basically saying they where in the right for charging but couldn't be arsed with the legal hassle so here's £1591.00 to shut you up. Now I'm quite aware that I could take it further and probably get the full amount but this could result in them closing my a/c and asking for a £500 OD back and moving to another bank with a 'cash account' which I can't be bothered with. Any advice on this would be appreciated.

Sent the first standard letter just before xmas and got the usual ` sorry you have complained ,we will get back to you in 10 working days`.
Tonight I came come to a letter stating that they consider that they were correct to charge for going over my overdraft limit but for commercial reasons will pay back my £115.
Over the moon, people power taking on the big banks!

I'm claming a similar amout (£2500). I opened a backup bank account with A&L before asking FD for a breakdown of my charges. I too have a £500 overdraft but in the last two years I haven't gone overlimit - my new A&L account has a visa debit card but no OD but I'd be happy with this if FD close my account. The impression I get from reading a few posts on here is that FD don't close down accounts but if I get to the stage you're at I bet I'll get a bit jittery too.
I'm at the stage of having sent the first request for refund of charges and been given the "we'll get back to you within ten days letter" which seems pretty standard. I'll update this thread as I go along, about how I get on with my claim.

i have made a claim against first direct for an unfair penalty under the unfair terms in consumer contract regulations also showing reference to the case of wilson v love , as guided by martins top tips website .The amount is over £5000 they have laid a defence and denied the charges stating the normal rubbish about terms and conditions giving them the authority to make charges stating they are REASONABLE AND PROPER . A couple of questions can anyone help ?
1. the amount in question makes the claim in the FAST TRACK process at court , this could involve issues with costs .Should i change the claim to £4999 .00 !!! to be under £5000.00 and then be in the SMALL CLAIMS TRACK .
2. first direct are being represented at court . What should i do ? who represents me ? who prsents my claim to the court ?
3. Is there anything else i should be doing ?
4. I have paid £250.00 to moneyclaim and am due to pay a further £100 to the local court. Will I have to pay any more ?
Can anyone advise and how do i speak to Martin Stuart?0 -
