    Got a call yesterday saying they can provide the statements but need to source the notes on the account I requested, which may take some time... I just told them as long as receive them within the time requested that would be fine. They also stated they would resove the claim for the charges asap.;)

    I have just received a reply from my second letter ti First Direct, they are still refusing to budge. My claim is for approx. £3500, they haven't made any offers either. Still stalling for time I suppose.

    So going to take them to court, has anyone else got this far with them? Any comments most welcome

    Aplogies if this has been covered elsewhere but maybe it's the terminology First Direct use that means I haven't been able to track down an answer!

    After weeks of messing me about/delivering statements to the wrong house THREE times, I've finally got everything through (Requested 7th December)

    Having spent 3 hours going through them I'm now cross-eyed and can only see a blur of SO,DD,CH,SWT,MAE, DR and of course the dreaded OVERDRAFT FEE and EXCESS OVERDRAFT FEE. One of the excess OD Fees was £119!!!:mad: Is this a record???????

    My question is, in amongst all these terms there's a monthly "DR Interest" fee. Some months this has been as low as £1.82, other times it's inbetween £15- £30.

    Can I include these figures in my claim? At the moment I've just used the online calculator to input the OD and XS OD fees only and these already toal £1,401.50. (£1,743.97 with interest)

    It would clearly bump my reclaim amount up if I were to include the "DR Interest" but can I do this? (as presumably I'd then be claiming interest on the interest??)

    Sorry if this is a dumb question but if anyone can help I'd be grateful!
  • I think the DR interest is on the overdraft itself, for example I have a £500 overdraft with FD and I got charged £1.78 on that last month, that is on the authorised overdraft that I used. You cannot claim this back because its the interest that you agreed when you signed up with FD.

    However, you can claim back the interest on the money that takes you over the overdraft, for example, you are charged interest on the £600 (£100 over overdraft) but this is difficult to work out.

    What i've done is claim the basic charges back, if they take me to court then I'll add the 8% stat interest on the claim.

    I just got a letter from the back (after my one asking for a refund) offering to pay back the full amount but WITHOUT the added interest that I asked for.

    I think I may well take their offer as it's money I never thought to see again anyway. Good idea or should I hold out for more?

    Personally I would take the money & run. Anything is a bonus especially the full amount.:beer:
    Just hope they are as quick with my case.

    Yeah I think you're right!
    And it was quick! They sent the statements for me quickly and for free. When I wrote to them asking for the fees I received a letter saying I would hear from them within 10 working days - that was today!
    I have to send a signed letter back saying I agree to the refunded amount and it will be transferred into that account.
    However, I am still waiting to hear from them re my 2nd account, but I'll give them another few days before getting back to them with letter number three.

    I hope my story gives hope to others!

    definatly record your deliveries as I sent one by standard mail as I had just missed the post office, funnily enough that one never arrived so I had to resend recorded delivery. I should refuse charges letters off them that arnt recorded.
