  • Interesting, I applied for an overdraft increase today, temporarily, and they said no and only moved it up slightly so I wouldn't get charged.

    Every other time I have had it approved without question, I did send off my initial letter for statements, then had it returned because I didnt sign it (doh!) and then promptly sent it back.

    I have an overdraft with them, more than likely to be in it when the payment is made (£361) you think they will credit my account thus paying off my overdraft or I wil get a cheque?

    Having looking at all your comments I thought I would give First Direct a call & see if I could just ask for the statements rather than send a letter.
    The reply I got was "yes of course we can, that will be 25p per statement!"

    I think its now time to send the £10 & letter.;)

    ps.Can you claim back the annual overdraft fee? I assume not.:(

    no you cant claim back an annual overdraft fee as its a service and not a penalty.


    As for an update on my first direct claim my second letters been sent 5 days still no reply. Im assuming they are ignoring me and are just going to let me start court proceedings. But hey I dont care im guaranteed the interest then anyway.

    I got my bank charges returned from first direct. No problem! Although I'm thinking of changing banks now as they want to charge £10 a month to have an account with them.
  • how long did it take between you sendingthe letter to them with the charges listed and receiving the money from them?
    Do they ask whether you accept it by letter first or do they credit your bank account?

    I've always been careful not to go over my overdraft limit, but just did last month as I didn't realise there was a standing order that had been transfered when I opened the account. Now First Direct has slapped with £30 fine, and I'm livid :mad:

    I know it's not legal and I want that money back - bit it looks like quite a hefty process with many people settling for a partial pay out. Is it worth starting the process for £30?

  • I'm sure for £30, if you were to go into the branch and ask for it back, they would give it back, out of 'courtesy'. That's if First direct have branches, I am not quite sure. If they don't, phone up and ask for it back. Simply explain the situation - new account, unaware of standing order being transferred etc.

    I had this problem but simply rung the couriers up (DHL) asked where their depot was and arranged to collect on Saturday am. Worth the journey if it means I'm going to get by my £1395 from First Direct!!

    P.s. you can only get statements online if you are registered as an online user.
  • I received from FD (within the 14 day period I believe) a letter saying that they would be investigating my "complaint" and then get back to me. DO I write the court letter after a further 14 days?

    As my claim is for £1395 then perhaps they may play hardball as I seem to be hearing. Just wanted to clear this up though if anyone can help...are Excess Overdraft Fee and Overdraft Fee both claimable charges? Or is the Overdraft Fee part of the agreed terms for the service as it seemed to differ from month to month.

    Help???:confused:

    you cannot claim normal overdraft fees , only unauthorised overdraft fees . This is normally a whacking 29% fee they put on the difference of the amount you go over your authorised limit .
