I've often got some good clear legal opinion there0 -
Hi, I want to start the ball rolling in claiming back charges for an account I used to hold with First Direct. Do I send correspondence to First direct, or HSBC? Also, on the template letter which bank name would I substitute?0

Scubajay wrote:I received a letter this morning from the department of Mr. Robert Kernagahan stating that they would make me an offer without prejudice of: £1046.
I was tempted but then noticed that they are not voiding the charges they intend to take in December (£80) and they had knocked off £100 of my accrued charges in the offer they made. I tried to call them to get these bits sorted so that the offer could be accepted, and they have given me the FD 8 week time limit to accept the offer. As they are still taking money from me, and unwilling to talk on the phone to me to resolve the last charge and the £100 I am going to let it run until the 19th (when the 2nd set of 2 weeks is up) and then start with the court claim.
As I gave them 2 weeks from the 5th I reckon it wise to let them have the 2 weeks, as I want a full refund of al the charges. Next step - Small claims court!!
Any advice?
Personally I would take the money they offered and run. Over £1000 is a lot better than you had before you wrote to them!
If they offer me that much I'll jump at the chance, but thats just me...0 -
I received a letter back from FD this morning saying that they would be sending me a reply in full within the next 10 working days. By my reckoning that's the 4th January 2007. Will keep you updated.
Any success stories from FD yet?0 -

Same position for me, a promise of a letter within 10 days but nothing... second letter's going tomorrow. Do First Direct seem to be offering anything now or are most people getting to the court stage?0 -

i think it depends on the claim ammount, it seems anything around the £1000 or above mark they are playing hardball. Delaying everything for as long as they can by promising responses but never giving them. They also seem to let every matter go to court but dont turn up and loose by default.0
