    i think it depends on the claim ammount, it seems anything around the £1000 or above mark they are playing hardball. Delaying everything for as long as they can by promising responses but never giving them. They also seem to let every matter go to court but dont turn up and loose by default.

    Well I've got a claim of £505 so fingers crossed something comes through. I've no qualms with going to court having taken a landlord to the Small Claims Court a couple of years ago and won! Although it seems it wouldn't even get that far. My tax bill is due next month so this would come in very handy...

    HI all,

    Have just had a reply from First Direct as to my claim of over £3000, they are saying that they don't agree that the charges were unlawful and directed me to the charging policy.

    Has anyone else had this and went on to the next stage? Any luck after that?

    This is a bog standard response used by many of the banks. Just move onto the next stage of your claim.

    I recieved the standard without prejudice letter 'mindful of costs of legal proceedings blah blah blah' ...gesture of goodwill...

    and they attached a letter for me to sign (acceptance) to send back.

    Haven't got any money yet though but should be next couple of days i expect.

    Interesting just rung FirstDirect to get a copy of all of mine & my partners bank account statements for last 6 years (as i know FD dont charge, no point sending the letter)

    And the customer rep on the end of the phone said

    'Thats fine ill get them all sent out to you by courier, and once you have totalled up all your charges you want back just send us another letter and we will get that sorted out for you'

    Sounds like they've given up already! Hopefully other banks will follow suit rather than fighting these charges!
  • i think it was always inevitable that after the money programme and publicity that either 1 of the following would happen

    a) they find a way to worm themselves out of it

    or

    b) they just payup straight away because of the added pressure of everyone claiming due to publicity. The departments would become overstreched and unable to process each claim so they would eventually have you just start paying up immidiatly.
