    I filed MCOL against Nationwide and they acknowledged on 16th March however I have not heard anything since. 1) Does anyone know if they are likely to proceed to court or if anyone has received settlements before court date? 2) :confused: They have until 12th April to defend - if not done by then, can I serve judgement?:confused:

    Hi i am also with the Nationwide and they seem to take ir right to the last minute waiting for a court date.Yesterday i was about to file Judgement sending it to my local court then i got the post,Nationwide put a defence it so i had to fill the Allocation forms in.We both have till the 12th April to put our Allocation forms in by,thn the judge looks at both forms and sets a court date.I have been payed some off my charges but not all.I got told by the courts it could take another 6wks till it either goes to court or get the rest off my charges bck.Seems like Nationwide like to drag it out till the last minute.

    Hello everyone, i am the guy that started this thread originally and good to see its still going strong , i have a court date for early June and expect it will not get that far but have to prepare anyway , the courts letter no doubt states the usual blah blah , but reads as follows .

    1) each party shall deliver to every other party and to the courtoffices copies of all documents upon which they intend to rely upon

    2) copies shall be delivered no more than 14 days before hearing

    3)original documents shall be brought to hearing

    4) signed statements setting out the evidence of all witnesses on whom each party intends to rely shall be prepared and copies included in the docs mentioned at (a) , this includes the evidence of the parties themselves and of any other witnesses whether or not the witnesses are going to come to court to give evidence .

    MY QUESTIONS ARE

    1) seems pretty straightforward , i have every letter ever written to them and all statements that relate to charges , is this all i need

    2) I assume i send copies of each set of docs to court/nationwide , is this the case

    3) Self Explanatory

    4) Little unsure about this , only thing i can think i need maybe here is copies of successful cases that have taken place ?????????

    Any help would be appreciated

    I am responding to the same letter right now, and like you wasn't sure what they wanted, my court date is 16th May.
    I went onto the CAG website, and they have developed a 'Court Bundle' which has everything you need, it contains relevent case law summarys and the OFT report summary.:D
    I've printed it all of and put it in with my statements, correspondence and interest/charges calculation.
    I don't know if the court will need everything that the CAG website suggests, but what harm can it do?:confused: if the judge doesn't want it he can just ignore it. better to be over prepared than leave something important out...

    well so far i havent received a reply from nationwide but theres still time, my second letter im gonna be sending next tues (3rd april) i jus hope they actually send me a letter if they decide to refund my charges to my account as the account was closed years ago. its now with debt collectors
  • Im new to this so hoping it works, I am in an IVA and we had an account with nationwide, just got 6 years of statements through. Our chages total 3k. However, we left them with a 1500k overdraft and 6k on a nationwide credit card. They are getting it back slowly but is it worth me persuing this. I dont know what to do, If I start claiming will they say Im not entittled as the Iva is in progress.

  • I am assuming an IVA is a payment plan, if so I have a similar question.

    I am in a DMP with CCCS which includes 4 credit cards totally 30k. Has anyone claimed charges in these circumstances. I wouldnt mind it being paid direct to the the debts either or should i just forget it.

  • I have successfully claimed back my charges from Nationwide. The court judgement date is tomorrow, what do I do about the court?

    If they've paid you, phone the 0845 number and tell them the defendant has paid up. (Or do it online if the option is there).
