    It is my understanding that you can only go back 6 years in England and 5 in Scotland
  • Nationwide acknowledged my claim for approx £1900 on the 2nd March, On Friday 23rd they part paid, still owing me £999. The court/judgement date is this Friday 30th March.

    What is my next step?

    If it is writing to them is there a template?

    Go to court!

    You do not need issue them with any further correspondance. They knew if they didn't pay up, they risked getting taken to court and so you should continue to hold strong and get what you are owed.

    I agree with Bakeybadoo. At this stage the bank is aware that you are now entitled to full amount & interest & costs. Dont settle for anythin less. I would however advise them in writing that you accept the payment in part-settlement without prejudice and will continue proceedings for the remainder. Just to keep things above board and ensure the banks know exactly the terms of your acceptance.

    I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.

    You also need to inform the court that part of the claim has been paid, and amend the amount you are now claiming for.

    Hmm, I didn't put 'without prejudice' on my letter saying the same to Capital One today...Should I re-do it, I've not sent it yet.

  • I have been the subject of a dirty trick by the Nationwide to avoid paying my charges. I originally applied in October to the bank and waited the 40 days as stated. When I contacted them again after the 40 days I was told they had not received my letter. I then applied again and again did not receive a reply even though I telephoned regularly(the usual answerphone where you have to leave a message) After a third attempt I have now received my statements none of which have the charges on because they were not as far back as when I applied. this looks like it was done deliberately pushing my claim forward by six months. has anyone else had this done and what did they do?:confused::confused::confused:

    Did you send by registered post and have proof of delivery?

    Dirt dealings indeed. If you sent letters recorded delivery back then you will have proof they received it so use that. Did you make a copy of the original letter ? If so that will be handy too.

    If you dont have proof of the original letter not to worry, the statements being sent now are proof enough of a request and you can file complaint to the Information Commissioner about the missing information. They have breached the terms of the Data Protection Act and the ICO will deal with that. You can complain about the missing information provided the 40 days deadline has now elapsed.

    For now write back recorded delivery requesting the rest of your statements. If they sent the details after the third request within 40 days then use whatever is left as a deadline to receive the rest. If they didnt send them within 40 days they are liable to respond immediately to fulfil the third request completely.
