    I'm about to do my MCOL form to claim my money from Nationwide. One quick question:

    Do I need to add the court fees onto the money I'm claiming, or will they automatically be awarded to me?
    Ali - still pretty much a newbie, need to brush up my MS habits!

    When you type amount claimed on MCOL, you put in what the bank owe you. Then MCOL works out how much the fee is (the cost depends on how much money you're claiming) and then they add it on automatically. It all makes sense when you actually do it! :rolleyes:

    I started the ball rolling with Nationwide a few months back and got to the point where they said !!!!!! off and my next step was to issue them with notice of intent to take 'em to court. But for various reasons I never actually got round to doing it.

    In the intervening few months I've since run up a few more charges :(

    So what do I do now? Do I:
    1. Start the process from scratch with the new charges
    2. Continue where I left of without the new charges
    3. Continue where I left off, but add in the new charges to the figure I put in the court forms?
    I've also got a query regards accounts being closed:

    I've read that Nationwide are some of the worst culprits for closing accounts after paying out and this is one of, but not only, reasons for not going ahead earlier. If they do close accounts, will it just be the accounts you have claimed money back or will they close all accounts you have with them (such as a joint account I have with my ma)? Also, as our mortgage is with them to, what about?

    Not sure about the accounts being closed but in regard to your starting the ball rolling again I'm in a similiar position. I last wrote to the bank back in February and got the letter saying naff off so my next step was to claim via the court. I didn't so I have been advised on the other site to send another Letter Before Action with 14 days notice then to claim - you can include extra charges up until you file at court :)

    Reading through this thread again it appears I'm rather unlucky!

    I have had my claim defended, allocated and a court date of November given.

    So it does seem that they intend to push me right up to the end whereas they have settled alot of claims before the 28 day defence deadline.

    I'm more than ready to get into to court with them, just wish the date wasn't so far away.

    I've tried contacting them but am being ignored, which they seem very good at!

    Well I'll just have to wait I suppose!! Good luck to all other Nationwide claimants.

    I'm still waiting for my court date - mycol stage ended more than a month ago! the 28 days was up on the 8th June.

    I rang the court and they said I should get a date end of last week or early this week - fingers crossed it's not going to be in November!
    Where are you based - I'm in London - I'm not sure if that will make it quicker or not.

    I've tried two different numbers for Nationwide and I've got no answer on both and can't afford to run up a huge mobile bill trying constantly!

    I have sent a letter last week saying that if it goes to court a self litigation fee will be added to the amount of £230.00 - I'm hoping that this will move them on but I doubt it!

    I can't believe you have to wait so long.. when did you start your claim?

    Oh my goodness I can't beleive it! I've just gotten home from a dull day at uni and to a letter from Nationwide. I just thought it was my statement so wasn't even going to open it. So glad I did! The 2nd paragraph read "I'm now able to confirm that we've refunded £934.10 in charges and cancelled £20.74 in pending charges on your account. We have also credited £80 to your account to cover your costs."

    How chuffed was I? I thought I was in for a long slog, or at least until a few days before judgement (which isn't until August 8th).

    However, the money isn't in my account so I called and they said it will be 3-5 working days. I will keep you posted on that!

    oh no, just checked my claim form which I completed on 30/06/07. Nationwide have up until next Wednesday to enter defence or pay up. Just noticed I typed 'Under County Courts Act 1894' and not 'County Courts Act 1984' regarding the interest on top of my claim. Starting to panic and feel sick in case it gets thrown out or defended because of my error (can't believe I made such a stupid mistake, especially as I and my boyfriend both checked the form so many times looking for any errors and didn't spot it!).
    Does anyone know if this will affect the claim?
    Amount being claimed from Nationwide - £2794.50 + £524.09 in interest = £3318.59 + court fees = £3438.59
    lodged with Moneyclaim online 29/06/2007

    Amount to be claimed from HSBC - £730.00 (charges only). Email sent to customer relations 01/07/2007 & letter sent by recorded delivery 02/07/2007 (to be on the safe side!!!!!!)
