    I've reported Nationwide to the Information Commissioner, i requested my statements on April 27th and have still received nothing.

    When i spoke to Swindon on Wednesday they tried telling me that they had 40 days from when they cashed my cheque...i burst out laughing at the guy on the phone and told him if that was their latest stalling tactic it wasn't going to work on me.

    Hi As anyone taken the Nationwide to court and won?I have been banking with them for 2 years and been incredibly careful, ie cancelling DDs when I knew i wouldnt have cleared funds in time - only to find out they need 5 WORKING days notice, and promptly charged me a small fortune.I have heard that they consider claiming back charges a severe breach of trust,and the banking relationship over. but surely they are breaching our trust when they charge us a penalty and not the fee they are entitled to?I spoke to them this evening and asked how the charge is actually made up and they didnt know, they put me onto a supervisor who couldnt tell me but said I need to make a request using the data protection, when asked why, they replied so they could look at my file.... So they now need to look at my file to decide how they calculated the unlawful penalty?????What response have people had when claiming back from Nationwide? I am prepared to go to court over this, I have all my statements, yes I learnt my lesson from suing the Abbey.Any experiences welcomed!ThanksSarah

  • I sent my letter off today asking for charges/statements. Then found this thread. I now have a few questions!!!:confused:

    1. Because I live in Scotland, doeas this mean I can only claim back 5 years charges, not 6?

    2. The limit in the Scottish courts is £750(roughly I think) and my claim is likely to be more than that, how do I claim through the English Small Claims Court (Nationwide HO is in Swindon, although I am sure i don't need to say that!)

    3. I didn't send my letter requesting statements RD. Would I be better to cancel cheque and resend RD?

    4. I have VERY big overdraft on my Flexaccount - have NW stopped closing accounts where people have claimed? If they haven't I will be in trouble!

    I really appreciate any advice anyone can give me. :heartsmil
  • hi all sent my second letter to nationwide asking for my charges back phoned up after 2weeks and the lady said she hadnt recieved my letter so i would have to send another , so just incase i would send ur letters recorded if u dont already, i just gave mine to the lady in the post office and assumed it would get there, probably did yet they say it didnt , but recorded letter is on its way lol cheers gill

    so much waiting around me nerves cant take it.:eek: im at the acknowledgment stage with nationwide they have till the 9th july to defend . do they always go all the way if so what do i have to do then . keep checking bank account but nuffink gone in:confused: if they do defend how much longer from that point . im realy getting nervy now already have bad nerves as it is. its for £4500 so lots of dosh better in my pocket than theirs

    When your claim moves from the letter stage to the court stage, everything does slow down and you do lose the complete control you had before. Just remember that the wheels of justice grind slow, but they grind exceeding small.”

    Its what I call the "Mexican Standoff" stage.

    If they pay up in full, great.

    If they make an offer or part payment, you can consider this, and then accept or refuse it and cancel or continue your claim.

    If they file a defence, the claim will be transferred from <ST1:p(where Money Claim Online are located) to your local county court and a date set for the hearing. Obviously, this depends on how busy the court is.

    If they don't file a defence and when the deadline expires, you can apply for a judgement by default on the Money Claim Online website.

    If you view the quotes from Edinbughlass she has some good advice for people in Scotland and i think i remember reading on one of her threads that if the Banks/Building Society head office is in England.

    Re your question about Nationwide closing accounts. I've been reading this site since Feb, and have noticed that a couple have said they have had their accounts closed, as Nationwide seem to play bully boy tactics. I too had a large overdraft on my flexaccount, and was scarred to claim incase they closed my account and demanded back their money. I decided the smart thing to do was apply for a credit card with 0% interest until 2008, i used Egg. I transferred my overdraft balance and opended another account with another building society. I am now paying 0% instead of Nationwides overdraft interest fee and using all my spare cash to pay off my Egg card. As the 0% interest is available until next year, its given me a realisyic time frame to pay it off.

    I have received my statements, and sent letter asking for money back, which they acknowledged within a week my saying my charges are my fault blah, blah, blah. Just sent 3rd letter today using template from this site that if i do not receive an offer i will take them to court.

    Hi its me again!! Thanks for the earlier reply. When I first looked into this I found the BBC site for how you go about reclaiming charges & it said if you only had partial statements as in my case I could only go back a year & then I multiplyed this value by 6 & sent the bbc template letter got usual blow out letter. Then found Martins site & then sent off Martins interim 2nd claim letter but still the usual blow out letter. Now I was not aware of the send a £10 cheque in & get the real amount & not a estimate. Should I now do this before I go for the claim or just go for the estimate claim regardless?

    Was wondering if anyone had rang their bank before taking them to court?
    I have sent my bank (Nationwide) the letter saying I will take them to court unless they pay up within 14 day's but today is the day and I have not heard from them. Shall I ring them before isuing court proceedings, has anyone else rang their bank and with that had results instead of goiing through the courts or should I just go to court now?
