    recorded delivery just allows you to show proof of postage and you can trace the item should someone claim it does not arrive : ).....

    recorded delivery...go into a post office with your letter and ask for it to be sent recorded delivery : ).....

    I've just started the process to reclaim my bank charges from Barclays. I sent off the data protection letter to get a list of all my charges about a week ago. Today I received a letter from Barclays stating that under the data protection act they can take as long as they want to return the data to me (I thought they were only allowed 40 days) & that they intend to take several weeks. I have a feeling that this is a delaying tactic on their part to avoid me making a claim until after the Office of Fair Trading makes its ruling. I don't think this is very fair & would be grateful if anyone could give me advice on how to deal with this. Thanks.

    they are....i would assume that it will come back much quicker, have a look at some of the earlier posts on this thread....there is lots of good advice and the general consensus is that you keep to your timetable and not theirs : ).......

    Dear All,

    On the issues of the OFT ruling and Barclays using delay tactics...they can delay all they want...see the below posting that has been cut and pasted from 'Moofo'.

    As a lawyer working in the UK i can categorically agree with the below statement. If Barclays want to delay let them. At the end of the day they are going to pay out anyway - just ensure that you mark up the Interest for every extra day it takes them to give you your money back...

    'The OFT carries little weight in court and does not govern UK Law.
    The banks must PROVE it costs £15 to send those letters.
    Simple as that.
    If they cannot prove the cost, it is still a profit making scheme and no court will find in favour of the banks.
    This OFT ruling means nothing apart from lots of people will get part of their money back straight away.
    All you need to do is file a claim in court for the rest and the Banks and credit card companies will have NO choice but to pay the remainder.
    The OFT will no doubt be revising this situation when they find it has changed nothing of the situation.'


    Good luck and keep it going...personally speaking - i put in for my repayment of fees last month. I got a standard letter from Barclays complaints saying they would respond by 19th March at the latest. I have called them up to state that:

    1. it was not a complaint - it was a letter asking for the return of my funds, NOT A COMPLAINT!!
    2. i had given them 14 'working' days rather than clear days as a goodwill gesture on my half and the deadline was 13 March

    the bloke i spoke with was very rude and told me that the letter was being treated as a complaint and that they had until 19th to respond. I informed the bloke that if i did not have a response by the 13th i would file at the court for full repayment, with interest and full costs. the bloke laughed and said i could do what i want!!

    i have written a seperate letter concerning the attitude of the call centre staff. I don't much expect a response to either and will be logging on the HMCS site on 13 March...

  • Sent of my dpa letter to the bank,

    whilst sorting stuff dd's etc with the bank i asked one of the advisors if they had recived my dpa letter, she advised me no but then asked if i would like the last 6yrs worth sent to me for free.

    i still havent recived them as of yet, but will keep updated.

    Im overdrawn at the moment, barclays have a nasty habit of letting me take money out of my account even though there isnt any over draft, can they do this, isnt it rather poor of a bank to let you take money you dont have outta your account????
