I am now at the stage of waiting for a court date, and since i started my claim in October '06 the interest has gone up by another £90.
Can i have this added to my claim, and if so how do i go about doing this? do i write to the court or the bank first????

dont want to miss out on £3500.

Both Barclays and I have filed our AQs before the deadline of 27th Jan but I've still not got a court date. I rang the court (Nottingham) on 5th Feb and they said I'd hear in 10-15 days but didn't so rang them again today and they said I should hear by Monday.

How long should it take? Are there any timescales the courts have to respond by? It's frustrating me that I can't move it forward!!

Hi all,
I have received a settlement offer from Barclays stating that I cannot claim back charges for guaranteed cheques, or debit card charges, as they will have been something that I agreed to as a service??
They are pushing me to settle for the amount claimed, less the charges for cheques and debit card charges, which means the claim is about £700 less. Can anyone give me any advice on this asap?

This seems to be a new tactic. I would go back to them and say you will be proceeding to court and the court can decide if those charges are claimable.

She is now saying this;
Guaranteed cheques are a service you agreed to so I cannot refund these charges. The other charges that cannot be claimed back are those where a debit has been made from your account, which is within the agreed guaranteed amount set on the account, but for which you did not have sufficient funds in your account. Therefore Woolwich would have paid the amount for you.
What do you think? She has upped the settlement offer by another £150.00 but the other charges she won't refund are worth around £600?

I agree with the bank about the Guaranteed Cheque Fee, this is a service, however the returned debit charge sounds like a penalty. Tell her you're happy to let the court decide if they won't pay up in full.

My claim to fame with Barclays is this.

I had a cheque bounce which was to be credited to my ISA held with Abbey. Abbey said that my cheque bounced and returned it to me. When I asked Barclays about it they wondered why it had bounced, baffled because I had 5 times that amount in my account. So they refunded my charge.

But for some reason they credited back my account with the amount TWICE! So I ranted to the customer service advisor at my local branch saying that the cheque amounts should cancel each other out. But for some reason it was posted back to my account twice! The woman was very ignorant and laughed at me, telling me "Mr **** I assure you that the bank does not make faults like this, and I can tell you that I know it's correct."

I being contradicted even after I told her that I'm an accountant. Even when looking on screen she didn't know what was happening! She kept telling me that she was in her job for 5 years and was good at it.

4 months later Barclays realise their error and took the money back 3 days after writing it. I was on holiday and luckily didn't need the money.

But I then complained that they took it back despite my humiliation on the day and continuous reminders. They gave me £200 for my trouble ;-)

Hi, Can anyone give me some links to sites that can help me prepare for the court date with Barclays? I don't want to get complacent about them not turning up!

I've found "The Small Claims Kit" on CAG.com but it's £10.99?? There must be advice in thse threads for free?!?

Sorry when I replied I assumed, obviously wrongly, that guaranteed cheques would be a valid charge however looking at Barclays website I presume its this one? Or perhaps the second one you mention? Can any Barclays customers confirm or deny this?
