I Was Very Unhappy Yesterday Having Recieved A Letter From Barclays Stateing About The Charges Being Put On Hold Until The Test Case. How Is It Right That They Have Refunded So Many People And Can Turn Around And Not Refund The Others,they Have Been Dealing With My Charges For 2 Months And Havent Found A Soloution,what Is The Likely Outcome?surely They Cant Refund Some And Not Others?0

Hi guys,
Just got a letter from the court teling me Barclays didn't respond to my claim so they now have to pay,woo woo!! The letter says it is Judgment for claim (in default). It says that the defendent has not replied to the claim form and is now therefore ordered to pay the claimant the money. I would just like some advice on how I now claim the money. I contacted the court as I didn't file the claim online, and they told me to go on Her Majesty's Courts Service - Home and go to the forms section, which I did, but really have no idea which form I need to claim my money back. Would really appreciate any advice any of you can give me.

:mad: Hi I am a new money saver in need of advice.
Started reclaim charges in February which amounted to £1715 Barclays offered me £1200 which I refused (foolishly?).
In veiw of the recent pending court case I then asked Barclays if I could take their offer of £1200 thinking that this would be better than a poke in the eye with a rusty nail!!! But was told that it was no longer on offer!! They advised me to send in claim form and wait and see what they decide to do after the court case.
Any suggestions?

Got the MCOL transferral of proceedings with Barclays three pages of defence. Can someone tell me when I get to hear when the case will take place?

With this "test case" announcment, me and my partner have decided to cut straight to the chase and have submitted a moneyclaim claim against Barclays for £2230 (£1740+interest) today. As it took nearly a month to get hold of the 6 years worth of statements, so god knows how long it would take to ask for the money back to!
Now I'm sure Barclays will try to issue a "stay" on the proceedings, I notice they've put an article together on their website:

More importantly:
"Can I make a court claim for a refund during the test case?
Yes, but we will apply to the court to put your case on hold while the test case is running. This is because the issues being raised in customer complaints on unauthorised overdraft charges are being considered in the test case."
If they do attempt to put a stay on it, is there anything we can do to overturn the stay?

I hope someone can advise me?
I have a court date 20.8.07 and the court have told me that the barclays havent yet applied for a stay. I read on here that they have taken to attending court to request stays directly from the judge. The court suggested i write to the judge to advise him that I am emigrating on 31.8.07 to look after my sick father and that i request the hearing take place. I was thinking of explaining that to return from so far away would cost many hundreds and would cause me financial hardship....is this a good idea..? Also I just note that the bank havent complied with the request to supply the other party(me) with the defence??? What does it mean for me if they have failed to do that? I did my bundle in time.
Please, any advice would be great

Hi there..... I "think" youlle be ok. It will be Judges discretion... unless some law has been passed to say otherwise.....and I havnt heard of one.
i think you have a good case so make sure you turn up and give your reasons... it may well be worth takig to the court some PROOF with you that you are indeed emigrating and WHEN.
As for the other point...... the bank HAS to provide you ,via the court, a copy of the defence.... that is the law. I would ring the court and ask them about that.
