Please help I have been claiming from Barclays for my son, have gone through process exactly as advised on this site. have received court date of 27 November 2007. Letter with this says The Claimant by 31 August 07 file and serve - (a) Schedule setting out each charge repayment of which is sought, showing the date, amount, and alleged reason (if any) for that charge being made. (b) Copies of any statement or other document relied upon as showing that each and every such charge has been made. (c) A statement of the Claimant's own evidence, if such is to be relied upon as tending to show that the alleged charges have been made, or that they are irrecoverable as penalties.
If Claimant fails to comply with this order, the claim will be struck out without further order. What should I write in the statement? Do I just list charges and dates and enclose copies of statements showing these?
It is District Judge Atkinson. It says the Order has been made by the Court of its own initiative. What does this mean, will this be on hold until after the test case? I am really fed up with this now - don't know what to do please help.0 -

Just found out about how i can reclaim all my charges!!!
Im currently with barclays and have been with them for 9 years!!
Im currently 250 quid over drawn!!! When i went over the 250 overdraft limit, they hit me with 30 pounds charges. They did this to me 3 times in a week!
I spoke to them on the phone about me going over my overdraft limit and they refuned me 1 of the 3 charges!!!
My question is am i still able to reclaim based on my circumstances???
Help Appreciated.

yes you can is the answer but do try and stop getting charges if you can, I know it can be hard...specially when your hit with £90 in one month are you banking with LloydsTsb by anychance?0

i recieved an email from MCOL over the weekend about cases being suspended by the courts, the following is an extract of that message.

i did get a letter from the warwick court to say i have until 17th August to pay £100.00 in court fee or my case would be struck out! thing was this came into force from 3rd August. pitty our billiant postal service decided to strike around now!
i just hope all this is worth it!

i recieved a letter from the local court in Warwick stating that if i did not pay £100 fee by 17th August 2007 my claim would be struck out with the result of additional fees being set against me with the possibility of the bank costs also! on check with the court they told me there is a exemption & remmision form on the same site that houses MCOL, the form i had to get was EX160 which is easily downloaded in PDF format.
I thought that i had no chance of gaining a remission for the fee or if i was lucky i would only pay a samll amount, i was very surprised when the clerk i gave the form to came back about 5 minutes later and said i qualified for a full remission and no fee was required!:j
So iam waiting now to see when my court date is and what will happen to my case, i hope the bank contacts me with a better offer before the date. on the other hand if a stay is put on my case i will apply for a lift on the stay as this is causing major financial hardship now!0 -

i am in the process of reclaiming 6 years worth of charges against Barclays, use the templates on here or the CAG site and good luck!0 -
Eight weeks from when i first sent my letter off, barclays send me a letter to say they are waiting until after the test case to deal with me. :mad: Another week and i could have had an offer. Ah well the only thing is that if it takes a year or two, i am going to lose the charges from 2001 etc. So in the end the overall total will be lower. But at least hopefully the law will become clear so the banks have to pay all the money they owe people.0

Gone through process as advised, Barclays sent offer I refused in May, defened my claim. I now have court date of 27th November. Dispensed with Allocation Questionnaire and allocated Small Claims Track.
Letter with court date says Claimant shall by 31 Aug 07 filr and serve schedule setting out each charge .... Copies of statement or other document relied upon showing charge ....... Statement of Claimants own evidence............. If fail to comply will be struck out.
Please help - what do I say in statement? Do I just send list of charges and copies of statments? It is Leicester County Court Judge Atkinson.

Have just returned to site, bad week, Wedding yesterday,Funeral Today, so have been off track. Right tomorrow 8/8/07 I will be phoning court to see what is going on and will let everyone know what my local court has told me about the outcome as what we have to do now.
I hope that they will let me know whether I have to input my papers next week as my court date is 31/08/07, so one copy to Bank and of course the higher archy the Court.
I am also at a lost at the moment, don't know quite what to do. I have received no communication from the court so I presume at the moment that everything is going ahead as planned.
I have bought all the books recommended so please come back to me with any queries, as I am so near my Court Date, I have bought myself the copier for all of the copies that have to be input to both parties.
I will send my results to you tomorrow in the evening to let you know what the court has told me what to do. ( and to save you money )
I hope that this will help everyone else, as I do not know what the reply will be from the Court until tomorrow, but if it stops everyone worrying about Court Bundles, I feel that this will help.
