    i have just been offered half of what i am claiming, should i fight on or accept the offer its 2700.00 so its alot of money to me. i am worried about losing the lot but feel i should have been offered more thanks:money:

    Hi,
    have put in my claim through MCOL but am a little disturbed to find that it has been allocated to a court in Northampton. Will I be able to claim travel expenses for the hearing. I live about 300 miles away!

    You've already let them take £2,700 off you unlawfully! Now you've started are you willing to let them keep £1,350? Its your money! Barclays will make you another offer if you refuse of about 75% ;) but personally I would not accept anything less than 85%! You know you are right and they are just trying to hold onto your money!

    I looked up some figure the other day for someone else's bank so I'll just let you know something about Barclays too...

    MCOL is based in Northampton. Once Barclays defend your claim :o it will move to your local court :)

    You need to complain to the Information Commissioner <- linked here
    You can do it on-line and Barclays WILL respond in less than a week ;)

    They defended both mine on the last posible day! I even thought I'd won by default on my first claim :( then it got cancelled on the 33rd day after the date I processed my claim :( MCOL allow an extra 5 day to allow for post and their staff to enter it on the system. The MCOL site will inform you once Barclays acknowledge and then again when they defend. You should be able to see this online but they will also post you the details too. :)

    I sent my letter to Barclays on 22nd May asking for about £1500 including interest. I then received the letter from them saying that they aim to find a solution within 4 weeks blah blah blah. ...........

    I then wrote to them on the 6th June threatening court action as in the letter template. I have had no reply within the 14 days.

    So i am able now to send the letter stating if they give me say £1100 i will take this as settlement or have i now made a rod for my own back and have to go down the MCOL road. Would it seem like i am desperate for the money sending the letter 6 letter containing the Without predujice paragraph?

    Any help would be greatly appreciated as i hoped they would give me an offer before it got to this point!
  • I have received a letter from Barclays (following my letter saying that I would take them to court if I didn't get my money back) saying that they are investigating my complaint and they will fully investigate my complaint and aim to find a solution within four weeks and if they're not able to, they will write to me explaining what's happening and will send me a full report or update within eight weeks.

    I assume this is just a delay tactic but should I give them the time or should I move on to the next step which is court.

    Can anybody advise me please?

    No it wouldn't. I sent them a letter asking for the figure minus interest without prejudice and they ignored it i have since taken them to court for the full amount which they have also ignored.
    It doesn't seem you can do anything to make Barclays think your desperate for the money.
    Barclays - Reclaiming - £3380 - stayed 30/08/07 - £2261 goodwill 20/02/09
    Abbey - Reclaiming £250 - 1st letter - stayed
    MBNA - Reclaiming £400 - received £294
    Morgan Stanley - Reclaiming £138 - received £120
    MINT - reclaiming £110 - received £90
    A&L - £170 charges - £170 back!
