    They dont want you to get the court to chase them! If you go into the next stage on the MCOL site against your claim and they don't pay up quickly they get fined ;) and have to pay court fees etc

    Write to them and give them 7 days to pay up or you'll put it back in the hands of the court for collection :D

    STILL CANT BELIEVE IT! Barclays have been on the ball with my claims but cut it a bit fine! They have a knack of getting the defence in at the 11th hour! I even managed to get a Judgment by Default revoked after a few hours because they got a defence in on the day! :(

    They could be ringing to make you an offer :D Don't be scared you're not in the wrong. The maximum amount for small claims is £5000 i'd be going for the interest aswell :rotfl:

    Cheers for the advise last time, but they never rang back afterwards. Instead I waited 11 days to receieve a letter saying I will have an answer within the next 4 weeks. So i must decide what now? It seems like not a bad response compared to some i've read, they also took the time to send another letter saying they are now going to charge interest on the £600 that I am overdrawn (with no overdraft) at the moment. :eek: After 10 years of me being a loyal customer they're not being very nice. So I might add my interest on after all. But I heard they are fair to charge this and it has'nt been all that much, which is why I was going to leave it off originally. :D

    Hi the 40 day time scale for sending my charges statements is up on monday and i haven't heard form them. Would you suggest ringing them? If so does anyone have the number to ring or should i just go straight to repeorting them? I didn't send the letter by registered post just first class. It took a lot of guts to send the letter and i am really worried about phoning them what would i say?
    I don't get nearly enough credit for not being a violent psychopath.

    :think: Hi, i'm not one to give advise really, i need it myself, but I thought i'd let you know mine arrived a few weeks ago after about 60 days. :angry: I was also nervous in persuing the matter and it has taken a lot to convince me that I am in the right. So its up to you, I am beginning to think it is best to take a tough attitude with them whilst being polite.:D

    Has anyone had there account closed with Barclays?

    I am bit worried as the amount I am claiming will not be enough to clear my overdraft

    :D I know this may be a bit off topic, but i'd just like to say, a family member of mine had their money back in full, after sending the third letter. It was Lloyds TSB though. At least we can be sure that there is a good chance all the banks will give everybodys money back. Anyway i will be sending my third letter soon, and not waiting 4-8 weeks as suggested by them, hopefully then we might have some action :D
  • Well i hoped it wouldn't come to this but i guess i had no choice when you take into account how arrogant the banks are in dealing with us all!, i have within the last few moments issued my claim details with MCOL for wait for it.... £4007.58:eek:

    that includes the interest and court fee! all i can say to those still toying with the idea of claiming your charges back is to go for it! all i can say is if you have set time limits for any response make sure you stick to them!

    i intend to reclaim all that they have taken off me over the last 6 years!

    Just to give a bit of an update, I was waiting to receive offer to settle from barcays litigation dept. on friday, and it didn't arrive in the post so rang and they faxed it straight to me with the full amount + interest + MCOL charges!!! I faxed signed agreement straight back. Just waiting for money to go in now!

    Not had my account closed, indeed have had one of their Customer Account Advisors on the phone, trying to flog me the Additions account (which I used to have and then closed, as part of my money-saving). Though spookily, Barclaycard have continued to nudge down my limit, without any reason I think, though probably cos I hardly use it.:j
