HMCS is showing status "Halted" does this mean that they have put in a defence?

ring HMCS and quote your claim number..they will tell you exactly whats happening...

    Hello all,

This is my first post although i am often looking on the site and boards.

Jumping straight to the point: I am reclaiming £1,100 from Barclays. They have just submitted a defense to my claim through MCOL and now we are being transfer to a county court. They did offer £600 ages ago but i rejected it. :T

Following the recent victory for Lloyds TSB against one consumer, will Barclay try the same? I know it's not binding but is this typical of barclays and has anyone been this far and can offer some advise?

Also, what happened to the Barrister to took his bank all the way. I was on holiday and missed the judgment!

Has anyone been here before and what should i do now? Continue? :o

Thanks to everyone and anyone in advance.

    Brad

Been refused point blank by Barclays, even when I phoned them they said that I should contact the Ombudsman.

It's only for approx £300 and in the light of what happened yesterday - is it worth it?

What's the best route to take - Ombudsman or Court? Or do they both lead the same way?

To think my first correspondence was December last year!!!

  • Hi
I started my claim with Barclays back in March. I have had all the usual stalling letters that eveyone else has had. My statements took over 6 weeks so I went to my local branch, where I had sent my original letter, and they said it had ben forwarded to Customer Services as they don't deal with it - how was I supposed to know this ???
Anyway got their version of the statements and worked through them adding up charges. Sent claim letter
I have had the usual letter saying it will take them 4 weeks to respond so I have replied with the court warning letter (as per Martin's template letters).
Do I just stick to my 14 days and then start the court proceedings ?
How easy is this to do ?
Bit (very) nervous about the court bit - my luck, (especially after yesterdays news), I will end loosing and paying !!
I thought I was claiming alot of money but after reading forum I am probably about average at £2840 without interest.
One of the main reasons I am claiming is cos I went overdrawn and started getting charges which made things worse. I did, as many do and stuck my head in the sand for a couple of months, then thought I should wake up and sort it out, so went to the bank to ask for help. Their reply was basically 'Tuff - if you had come in when you originally went overdrawn we could help but now - go away and sort it out yourself & in the meantime take this next £35 charge !!' Grrrrrrrr !

Hi sorry if I am repeating myself here, but haven't had an answer yet.
Sent off my LBA to Barclays on Monday 14th May as they had sent me the usual fob you off letter about it taking four weeks plus to sort out.
After I had posted it I realised that I had forgotten to sign my name at the bottom.
My name is printed, just not signed.
Will this make any difference to my claim??
I am getting quite worried about this so if anyone can help clear my mind it would be greatly appreciated.

    Hi guys,

I have a situation and im after your thoughts and suggestions guys.

I started reclaiming my fees from Barclays at the start of the year. I started as normal by requesting the fees which Barclays ignored. They offered £100 which i declined. I then started the court proceeding by completing the MCOL and waiting. They then paid £340 into my account.

Now the court have sent me the papers to complete and im scared ill have to go to court and they only owe me another £200 or so, so it doesn,t seem worth the hassle?

Will Barclays give in, should i contact Barclays?

    Any help would be great

    Thanks in advance

    hi all

I have received a letter in response to an email complaint sent via online banking 1 may with regard to postal credits, i asked for statements and asked them to let me know what fee and if they could not supply them and emailed again on 8 may when nothing heard

Althought the letter does not address my initial complaints it apologises for my not receiving statements and that they tried to ring me at home to discuss

"our advisors were not aware that there was a delay in issuing these statements. This was due to the high volume of requests that we are receiving due to the media coverage regarding Bank Charges. I am sure that you can appreciate that printing six years worth of transactions, for all customers concerned, is a lengthy process. We are processing these requests in order of date that the request was received into Barclays, to make it fair to all our customers. I will now forward your request onto the correct department who will action and send your statements within 28 days."

a number is offered if my concerns are not fully addressed and that the complaint file will be kept open for 8 weeks

"Our aim is to resolve all complaints internally, although we recognise this may not always be possible. If we are unable to agree a way forward you may be able to ask the Financial Ombudsman Service to review your complaint. We will help if you would like to do this, however I hope we can resolve matters for you before you take this step."

I hope this is of interest and help to someone, address on letter is

    good luck one and all
