Hi all, i am at the stage of being just about to put a moneyclaim in. reading some of the posts, i think it may be wise for people to also check out the info on the consumeractiongroup.com website as they have TONS of resources for peeps going through the court process. it's just another resource to get info/advice from so you can take some of the pain outta your claim.

Have recived 2nd letter from Barclays as follows.
May i say how sorry i am to learn that you feel the bank charges you have incurred are unfair, In your correspondence you have referred to elements which you feel support your claim, Barclays is aware of the information you have drawn to our attention, I must inform you , that we disagree with your view.
When an account is opened with us, our customer is provided with a copy of the terms and conditions relating to the use of their accounts; including details of our charges, This information clearly explains our obligations to our customers, as well as their obligations to us. If we make any chanfes to the terms and conditions, WE provide details of these changes to our customers in line with the banking code. details can be found at any Barclays branch or via the internet site.
In view of my comments above i am unwilling to refund any charges you have incurred as requested.
if you are dissatisfied with my response you may be eligible to refer to the Financil Ombudsman.
they have given me eight weeeks to reply or they will close my case.
what to do now please.

Sent letter to local branch dated 28th March for 6 years bank statements - have not received any reply to date. Went into branch yesterday and asked where my statements where and the reply was 'is it 6 years worth, oh yes we have thousands of requests and we will get to you eventually' when i asked how long it would take they said '4-6 weeks' I said'but it has already been 6 weeks' Customer Services reply 'well all I can say is that you will definately receive your money back'
I am now going to email barclays through their website - see if that can get things moving!!0 -
Trust me on this. As long as your cheque has been cashed issue a non compliance claim form against barclays and estimate the damage caused As if they do not comply then you get your damages by default.ONLY COPY WHAT I AM DOING IF YOU ARE 100% SURE AND YOU KNOW EXACTLY WHAT THE END RESULT MAY BE. I added up £935.00 charges plus interest totalling £1029.00 that Barclays owe me, and sent them the letter. After a few weeks they have offered me £700.00 as a 'goodwill gesture' and sent a form to agree 'in full and final settlement' etc. and stated they will pay it into my account - only they have pulled my overdraft and account. So - do I let them wipe out the deficit or can I demand that they pay me via cheque/or into my other account at another bank, and offer to pay them off gradually? Or-do I hold out for a better offer and threaten them further with legal action?
Any help and advice would be much appreciated..thank you.
If there is a debt on the account they will likely pay any monies reclaimed into the account with the debt and I don't think you can demand a cheque.
Depends how far you want to take this or how long it will take to carry on as £700 is quite a good offer on £935 but of course the decision is yours.0 -

should i be a pest, too and email them every day (it would be impossible for me to go to the branch!!), or should i just send them the 1 message, saying that i want the info i've requested within 7 days or i go to the information comissioner (and actually do that)? they've already had well over their 40 days, and i'm no no mood to work to their timetable!!:mad:0
