Can I claim back charges off a closed account???

    Yes you can claim from a closed credit card. I have with MBNA which they closed last August after I paid them off in full. They sent me a "goodwill gesture" of £870 and I've filed with MCOL for the remaining £1251.

    Just send them the same letter with your account number and word it along the lines of:

    I am writing to request a comprehensive list of all the default charges including Over Limit Fee, Late Charge and Unpaid Payment Fee I have paid. etc etc

    Could anyone please offer any advice?

    I am going to try to reclaim the charges that were applied to the g/friends Halifax loan account (there was quite a few!). However, this is a closed account and she does not have the account number.
    How do i go about requesting the details?
    I have info off her credit report i.e Date opened and date settled,address of lender.
    Will this be enough to get the statements i want if i send this info in a template letter with £10?

    Any help appreciated.
  • I have had a nightmare with HSBC in the past and the result of this was that they closed my personal account. Can I still reclaim charges made in the last 6years on an account that has since been closed?

    I have had 3 cards with Capital One at one time or another. 1 each for me and the mrs and a joint one too. I was definitley charged late payment fees during my time with them.

    My first question is, I don't have my statements, but I do have the account numbers, so should I send one £10 fee to cover all 3 accounts when I request the statements?

    Secondly, am I asking for statements or just a breakdown of the charges applied?

    Thirdly, can they say no to my request for these?

    Last but not least, can I claim over the limit charges or not?

    I am confused about the oft guide of £12 for a charge. Should I be claiming for all the charges incurred or just the difference between the charge and the £12 oft figure?

    I am confused......and am getting conflicting information on this one.
    I would appreciate you advice.

    My LBA in March clearly stated that I would be taking action against them if by 5 April I did not recieve a full refund. I thought I would ring them today and got this wee girl who stuttered and stammered repeating what was in their letter I received YESTERDAY (4th April) ..."....you will receive a response from us within a maximum of four weeks, in-line with the Financial Service Authority regulations. "
    Do I still have the right to file against them TODAY..or are THEY within their rights to hold out another 4 weeks."
    I dont want to seem unreasonable.....smiles......She told me that they were in undated with 1000's of such claims....(surprise , surprise) and there was a back log.
    I told the wee girl that it was their chance to settle NOW in full or face paying the interest plus my court fees a later date as I planned to go to the small claims court..... it was their choice.
    She said the Bank was still within THEIR rights and had another 4 weeks to respond. And she didnt even take the reference number or anything to check the amount of my claim.....I could have been anyone! She didnt even take my name!
    Must I wait the 4 weeks?

    What should I do..

    File the court claim now. Ignore their stalling tactic.
  • Hi im wanting to reclaim charges from my old mbna cc that i got a loan to pay off about 3 years ago could some one tell me if i can still do this as i closed my account as soon as i paid my dept off would they still have my file.
    any advice would be great

    I have just received a cheque in full settlement of my claim For £901.72 from a closed account with RBS. they had offered £311 as a partial refund but I took it further and the cheque arrived

    thanks to everyone on these boards for the advice and good luck to everyone who is currently in the process
