  • oh and another one what are CHARGES? vary between £6 and £40 over the last six years all other costs are explained ie. unpaid items. do i need to ask for explanation from the bank? initially they seemed to be monthly amounts which i pressumed were account fees but these bigger and more recent amounts seem randomly applied!
Time, Tide and Diarrhoea wait for no man. ;)
  • Have found Natwest to be extremely cagey about the whole process.

They basically claimed ignorance until they recieved the Notice Apellant from the issuing court. I remember reading on here that Natwest settled upon receipt of summons. This was on the authority of someone working in Natwest Complaints dept. Certainly seems to be the case as Natwest Credit cards are processing my complaint in exactly the same way.

    Good luck all

    Hi folks

After successfully reclaiming my charges, I wrote to Cobbetts and reminded them that in my original Higley letter I asked for defaults on my credit history to be removed which were a result of these charges.

They have written back, saying that NW will do it...

If this has affected you, make sure you ask!

If you have not sent your letters yet, make sure that you send the ones from CAG site as they have a paragraph in them about removal of default, whereas the letters on here are a slimmed down version and they dont have this paragraph on them. I have learnt this mistake at my own cost. I am now having to do further letters, haggling and possibly a court claim to get them to remove the default, as i never mentioned this in the original letters and court claim. I thought you could just write to them, but unfortunately, whilst you can do this, they do not have to comply. Whereas if i put this in original letters and court claim, they would have to. Does that make sense.

  • Thankyou for that pigginsexy , i have sent the first letter last week from this site so its not mentioned the default . Will it be ok to put it in the second letter as that will be due to be sent off next tuesday ?
  • Hi guys.

Could you let me know if this seems acceptable....

    Dear Sir/Madam

I recently wrote to request that you repay all the default charges that have been applied to my account. I enclosed details of all charges that have been applied within the last six years.

The matter was passed along to the customer relations department and I was told in writing (dated 9th Feb 2007) that I will be contacted within two days although I haven’t received any correspondence as yet.

I would appreciate it if you were able to contact me within 7 days in order to resolve this issue.

I am waiting to hear from the customer relations unit.

To be honest i dont know. All i know is that i did not mention it at all in any of my letters so cannot use it in a settlement/court claim!

I dont see why you could not mention it in your 2nd and subsequent dealings as at least it would prove in court/settlment that you want the default removed. Try it, it will either work or not.

    Keep us informed

Sounds ok, but its a bit nicey nicey. I would simply state that you have a further seven days to respond to my request and should i not received a response within this time period, i will start the court process. Or something along those lines.
