  • Natwest have completely ignored both my letters (after recieving statements) so as soon as I've been paid (march 6th and counting) I'll be filing my claim with MCOL.

    Has anyone else been completely ignored until court?

    Received a pre-dated offer of 70% of claim this am from Mr Niggely (60% of claim including interest and court fee). Meanwhile clock is ticking on their 28 days to file defence which expire next Wednesday.

    Anyone know whether they are likely to file defence or should I hold out for 90-100%?

    it took them ages to deal with mine (10 weeks or something) though only sent the first letter asking for money back, got back an acknowlegment to buy them some time to deal with it

    If you hold out, you will very likely get the full amount of your court claim back.

    You can write to the bank with something like....................

    I cannot accept your offer of £XXX as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. I will now settle only for the full amount of charges+statutory interest+court fee.

  • Has anyone else switched accounts whilst reclaiming that could shed any light on how Natwest react?

    I've just been informed by letter that the Customer Relations Unit at Natwest will now be dealing with my complaint regarding my charges, but I already applied for a parachute account with Alliance & Leicester. All the paperwork to switch all my salary details, d/d's and s/o's is ready to be signed so that A & L can transfer everything to their account and then close my Natwest account down, but I'm just a bit apprehensive about shutting the Natwest account whilst the ball is rolling. I don't know whether to hold on until this has been resolved but I've heard the time scale for resolving varies a bit.

    Does anyone have any experience with this that they could share, please?
  • Hi there I just want to offer some encouragement to anyone who is going through the process or is thinking about it. Yesterday I recieved my cheque from Natwest for the full amount of my claim plus interest plus court costs
    (£1632.99). I sent my first letter on 24th November 2006. After no reply I filed my online claim on 7th December. Cobetts filed a defence on the last day of the MCOL deadline and so the claim was transferred to my local county court which cost me an extra £100. I started to get a bit nervous aat this stage but was determined to follow the process through to the bitter end. After recieving my CPR pt 18 request from Cobbetts I sent them a letter telling them I had no intention of replying to their request for further information. Filled out the Allocation Questionaire for the court, sat back and waited. I then recieved two offers the first for £750 and the second for £1054, rejected both before recieving a court date for 23rd April. I also recieved a letter from the court asking me to supply a full schedule of charges that I was claiming were unlawful BUT also ordering the bank to provide its own schedule of charges with full details of their actual costs. At this point I knew I'd won and lo and behold a week later I recieved a cheque for the full amount. So my advice is stick with it, you will recieve the full amount but may need to be prepared to go all the way, anytime I was unsure what to do I found all the answers I needed on this site or on the CAG site. Don't be intimidated it is your money.

  • Rang the customer relations people the day after my 14 days were up and have received an offer this morning for the full £1171. I would have gone all the way if necessary so to all of you who have to go through the court stage just stick with it. With all the help and encouragement on this site you can't fail.
    We finally did it! Debt free 28/6/10 :T :beer: :T :beer:

    thanks for all of the encouragement, will now start proceedings against gnatwest, any advice on the best parachute accounts for personal and small business
