Before sending off a complaint to the IC. It may be worth sending THIS LETTER. It got Natwest moving ultra quick when I sent it to them.

    Hi,

I have had no initial response from my first letter to natwest and it has been 14 days. I am about to send the second letter asking them to respond within 7 days.

Since my first letter however I had received further changes, can a revise the list of charges or do I need to keep the charges the same as what I was claiming for in my first letter?

    Your help is appreciated.

    Nick

You can add in charges up until you put the claim through the courts.

    Hi folks,

I received my copy of Cobbetts Allocation Questionnaire this morning, and in the Other Information box they have written:

"Case management directions cannot be proposed until the Claimant serves a Reply to the Request for Further Information which was due on 7 February 2007. In light of this, the Defendent may amend its Defence or apply to strike out".

I originally received a Part 18 request with a copy of Natwest's defence and my own Allocation Questionnaire. I replied to Cobbetts with the standard "I'm not answering this" letter, along with copies of my schedule of charges and all interest I was claiming etc. I also forwarded a copy of this to the court along with a letter stating that I believed it to be intimidatory tactics, as suggested on the Bank Action Group forum.

Have I done the right thing? I used standard template letters originally, so I'm sure all the information Cobbetts needed was in them originally, and they've had multiple copies of my schedule of charges. Should I just ride it out and wait for a court date, or would people suggest I pull together some more info and send it to Cobbetts? And if so, what?

    Thanks for any advice.

You have done exactly the right thing. I received the same thing (to the word) in my Allocation Questionaire from Cobbetts. I wrote a letter the same day to the Judge who was handling my case and wrote that I was very dismayed that Cobbetts may amend its' claim or apply to strike out, based on: A: CPR 18 doesn't apply in the Small Claims track, and: B: I found it very unusual that they were asking for more information as the NW had already supplied them with that. I sent a copy of this to Cobbetts also :D

    Hi All,

I'm sure I can rely once again on your help and advice. I have just noticed this thread about Bank Charges....don't know why I didn't notice it before.

What charges can you claim for?
Do you find these on your statements?
Are there any draft letters I can use?

    Thanks.

    Lea

  • Hi folks :D

I just have a couple of quick questions. I hope someone can advise, I have looked through this thread but it is quite long!

I sent off all my statements to claim £1599 a week ago

Today I received a letter saying my claim had been passed through to the customer relations deprt and they would contact me within 2 days.

The letter was dated 9th Feb.

Q1. Should I ring them, I would prefer not to do this as there is nothing in hard copy.
Q2. Do I need to write another letter if they don't contact me in 2 days? If so, who to? Do I need to include all my statements again?

    Many thanks guys.

Stick to your time frame. I.e send a letter in 2 days giving them a further 7 days. I would send where you sent original letter and also cc it to branch and Borehamwood (customer relations).

Did you send a print out of charges or statements? You should not have to send statements as they already have these. I would send a copy of your print out again.

    Good luck
