Then comes the 'however, as a goodwill gesture etc'. where they offer me £620 out of the £970 that I claim. I want to reply tomorrow with the letter before action, but I was wondering if and how I should respond to their claim that the charges are for 'services' as opposed to 'penalties' - anyone know what the implications of this is?0 -
I know there are far more knowledgable people on this board than myself, but going from my experiences with them, I had a similar letter early in the process. They offered me £88 back then, so I was not amused.
I wrote the following ( .. amongst other things) and posted it off pronto: " .. I do NOT believe that these charges are fair, reasonable and transparent. I'll let the Court decide that."Nat West = CONQUERED: 10/02/07 .. PAID UP IN FULL .. OVER £2800!! :j0 -

I believe that you cannot claim for the subscription, this is something you agreed to. (I have not claimed for it) and also it is a "subscription" you get some goodies with an AG account (travel insurance etc.) Somewhere on this thread is a list of what can and can't be claimed, I think it is around thread 3 or 4.Whoever said "it's only money" had too much of it!;)

Thanks Ken, that sounds good. I'm more curious about how I should respond to their claim that they charge for 'services' instead of 'penalties'. Any help anyone? Had anyone received anything like this from NatWest before?0 -

I think Ken is on the right wavelenght there. It's an attemp at Bull**ite to see if you are going to go away easily.Whoever said "it's only money" had too much of it!;)

Hi folks,
I received my copy of Cobbetts Allocation Questionnaire this morning, and in the Other Information box they have written:
"Case management directions cannot be proposed until the Claimant serves a Reply to the Request for Further Information which was due on 7 February 2007. In light of this, the Defendent may amend its Defence or apply to strike out".
I originally received a Part 18 request with a copy of Natwest's defence and my own Allocation Questionnaire. I replied to Cobbetts with the standard "I'm not answering this" letter, along with copies of my schedule of charges and all interest I was claiming etc. I also forwarded a copy of this to the court along with a letter stating that I believed it to be intimidatory tactics, as suggested on the Bank Action Group forum.
Have I done the right thing? I used standard template letters originally, so I'm sure all the information Cobbetts needed was in them originally, and they've had multiple copies of my schedule of charges. Should I just ride it out and wait for a court date, or would people suggest I pull together some more info and send it to Cobbetts? And if so, what?

I've had a cheque through for £1500, (claim was originally £1100) and it cleared yesterday!

Morning,
just got a letter from Mr Postie, got all excited as thought it may be an offer.
No such luck, they have acknowledged the claim and have said they intend to defend all of it.
Oh well must have been very wicked in a past life ( or maybe this one), looks like they are going to hold out on this one.
I have had further charges added since the court claim was filed, does any one know if I can add these at court or leave it.
