  • By the figues you have given the bank's offer is for both accounts. They will not give an offer including the interest because they are not legally obliged to pay this, only the court can make them pay the interest.
  • Hello again folks,
    Natwest are applying a little lateral pressure on me at the moment, threatening to take court action unless I clear the debt on my account immediately ( the majority of which is down to the £6k bank charges). I have prepared a letter in return, having been through all but the last phase of this procedure (i'm now at the 'pay up or we'll go to court' stage and they're wriggling like a 10lb salmon) and i'd appreciate an experienced opinion on it before i send it.

    I am writing in response to the second of two letters I received since requesting the refund of my bank charges from Natwest. The latest, from your Solicitors, Green and Co threatens court action unless the above account is not called to order. I should let you know that if you insist on following through with this threat, I will be presenting the detailed bank charges as evidence of fraud on Natwest’s account, at which point your institution will be called to account for their validity.

    Please consider this communication as my final offer to resolve this out of court and I look forward for a full response within 7 days.

    Can i accept this and then go for 2nd account and argue the case that it is their mistake as they only put one account number on the letter.

    Also, if i do decide to accept (probably will), instead of having to go through MCOL again, could i not write to the court to say that i have accepted an offer on one account but still wish to proceed with the 2nd part of the claim (i.e 2nd account).

    Whilst at it, how would i word a letter to Natwest to say i accept this payment and wish to have the default removed from my credit file.

  • I have two accounts (all my letters and the claim that i put in, which has been acknowledged, has always been for the two accounts jointly).

    They may have only put one account number down but I personally think as you have claimed for both accounts jointly the offer is for both accounts.

    Sorry no idea about the default bit.

    Thats the bit i dont understand.... The offer letter is dated 2nd feb (received 9th feb) and they acknoweldged claim on 8th Feb. Can i still accept offer although they have acknowledged claim?

  • Obviously letters have crossed in different departments. If I was you I would grab their offer, cancel your court case and be done with it.

    Rex, you were right! The Nat West finally caved in. I received a cheque this morning for the full amount .. over £2800! :j

    I'm not allowed to disclose much else, but I will say to anyone who's nerves are shredding at the thought of going to court: DON'T BE SCARED .. DO IT!!

    I really thought that I'd be "the one" that the bank was going to win against :eek:

    Thanks to the patience of Rex_Mundi for his suburb guidance through questions that were driving me up the wall ( .. only 4 working days to go before the Court appearance) .. he steered me through uncharted waters :T

    Funny thing is that the cheque's dated for the 2/2/07 and it got posted to my next door neighbour's address yesterday, as Cobbetts' had put the wrong door number on the postal address .. idiots.

    I'm going to stick around and help out as best I can other members whose experiences are similar to mine :cool:

    Dalt, I wouldn't say I was the experienced opinion you're looking for, but I do watch this forum very closely, and take advice from it. So for what it's worth.......
    I would not send that letter. Something that runs through all the advice posted here is not to get shirty with them, although, believe me I do understand where you are coming from.
    Stick to the tried and trusted formula, State your case, as you have done, and your timescales and stick to it come hell or high water. We've all seen the dirty tricks and scaremongering they try. Keep your nerve. If they do try and sue you for the outstanding balance on your account I would have thought that a very good defence would be that they are only doing it to you because you are doing it to them.
    Do you have any idea why they are threatening this?
    Whoever said "it's only money" had too much of it!;)

    Nat West under my belt £4532, LTSB, £7300, Barclays, £2300, First Bank of America, £3200. Rates overcharge £1700. Just working on Egg
  • Their threat only came after i sent the first bank charges letter, so I presume they're just trying to intimidate me. I do have to respond to their threat soon though so, if you think the letter I was going to send is inappropriate, what do you suggest?
