Just a quickie regarding the Money Claim online. (All these dates are getting confusing!)
As I understand it originally they have 14 days to acknowledge then once they have done this it goes up to 28 to reply.
Does the extra 14 days start from the date they acknowledged the claim (claim acknowledged 26/1)? and if so, when that 14 days is reached (which should be friday by my reckoning) do I then start a judgement by default?
AND if i DO get to that stage. Would i start the judgement on Friday or wait until Saturday?

i know i got myself in trouble in the first place but as the day goes on i am more and more proud of the fact that-

2) I have cleared £4061 of debt that otherwise would have taken me years!!!

Sorry to post again, but one thing I would like clearing up if someone could help.
If I claim for more that £5k, say it is about £7k+ do I still go through the same channels ie courts? Do I have to get a solicitor myself?
I heard that above £5k its not the small claims court. So is there a different claim I have to fill out to apply to a different court?
Please advise as this has confused me now (mind you, thats easily done)

You can claim this in one, but it may not be dealt with in the small claims track. Other tracks in court can be a little more complex.
You could always split the claim for the court case.............
2001-2004.........£4000
2004-2007.........£3000
These are example figures, but both these amounts would keep you in the small claims track.How many surrealists does it take to change a lightbulb?

My boyfriend has jumped on the band wagon as I have and am nearing the final stages with HSBC. He is in exactly the same situation as Tross, please help as if they remove his overdraft then he doesnt want to claim, as far as i was aware claiming bank charges doesnt go against you credit wise so relistically they would have no real reason to do this, but then banks make up their won rules on what they can and cant do. I asked Natwest for my statements. If I may paste the next bit because I am taking notes of what goes on with them.
Ordered 6 years worth of statements (01/01/2001 to date), via letter handed to main branch, on Sat 27 Jan 07
Received, Sat 3 Feb 07, statements for 15 Dec 2000 to 4 Oct 2002
Phoned Natwest Sat 3 Feb 07 to ask why I only had the statements I had when I asked for 6 years worth. Asked to be put through to Statements Dept. Told they don’t open weekends and to phone back Monday and speak to them.
Phoned Mon 5 Feb 07 and asked to speak to Statements Dept. Not put through. Told the statements have been sent but they can be resent free of charge if I haven’t received them. Said no to that. I would wait.
Phoned back Mon 5 Feb 07. Asked to be put through to Statements Dept. Not put through. Told they have been sent a year at a time, due to the Data Protection Act as it’s a lot of info to go missing if 6 years worth was lost in the post. Told I should receive them tomorrow (Tues 6 Feb 07).
Statements not received. Phone again Tues 6 Feb 07. Asked to be put through to Statements Dept. Not put through. Told I only ordered the statements on Mon 30 Jan 07 and they are in the post and I should receive them today (Tues 6 Feb 07) or tomorrow (Weds 7 Feb 07) as it takes 5 – 7 working days. Said that’s not the issue. Said I have received some statements but only for 15 Dec 2000 to 4 Oct 2002. Was then told that up to 2002 they used a different system for statements and that I should receive the rest by Thurs 8 Feb 07. Said I will give it until Fri 9 Feb 2007.
My wife has had the same with Barclays. Told one thing by one person and a completely different story by someone else.
I have decided to wait for the statements as I went online to Natwest banking and calculated how much was owed over the last 6 months. Did my sums and estimated I am owed £7300+. If I try and get that back and its over estimated they will know and put up a defense. Best to wait and get a definite figure.

Im sorry to say but I used to work for Barclays and I was a culpret of the tell em anything to shut them up was of working and yes that is what they do, unless you research the stuff before you call them or demand to speak to a supervisor you will end up talking to a spotty 16 year old that has spent a week getting drunk at barclays training facilities all expenses paid and I know for a fact natwest do the same.
