  • Why do these banks insist on employing people who feed you no sense answers?

I asked Natwest for my statements. If I may paste the next bit because I am taking notes of what goes on with them.

Ordered 6 years worth of statements (01/01/2001 to date), via letter handed to main branch, on Sat 27 Jan 07

    Received, Sat 3 Feb 07, statements for 15 Dec 2000 to 4 Oct 2002

Phoned Natwest Sat 3 Feb 07 to ask why I only had the statements I had when I asked for 6 years worth. Asked to be put through to Statements Dept. Told they don’t open weekends and to phone back Monday and speak to them.

Phoned Mon 5 Feb 07 and asked to speak to Statements Dept. Not put through. Told the statements have been sent but they can be resent free of charge if I haven’t received them. Said no to that. I would wait.

Phoned back Mon 5 Feb 07. Asked to be put through to Statements Dept. Not put through. Told they have been sent a year at a time, due to the Data Protection Act as it’s a lot of info to go missing if 6 years worth was lost in the post. Told I should receive them tomorrow (Tues 6 Feb 07).

Statements not received. Phone again Tues 6 Feb 07. Asked to be put through to Statements Dept. Not put through. Told I only ordered the statements on Mon 30 Jan 07 and they are in the post and I should receive them today (Tues 6 Feb 07) or tomorrow (Weds 7 Feb 07) as it takes 5 – 7 working days. Said that’s not the issue. Said I have received some statements but only for 15 Dec 2000 to 4 Oct 2002. Was then told that up to 2002 they used a different system for statements and that I should receive the rest by Thurs 8 Feb 07. Said I will give it until Fri 9 Feb 2007.

My wife has had the same with Barclays. Told one thing by one person and a completely different story by someone else.

I have decided to wait for the statements as I went online to Natwest banking and calculated how much was owed over the last 6 months. Did my sums and estimated I am owed £7300+. If I try and get that back and its over estimated they will know and put up a defense. Best to wait and get a definite figure.

    Will keep you posted. :D

just spoke to natwest and because my loan and bank account have gone to the CSM dept, any of my charegs have to be paid of them :(
so all the £4037 will pay off natwest and i dont get anything. feel now like i shouldnt have bothered but silver lining and all that is now i will pay off one creditor and instead of owing £16033 in total i owe £11996
just have to tell OH now eek!

i had this with them last week 38 pound charge for being 2 quid short! which had atcually been transferd from another account to cover it but they took d/d before putting the other money in- any way i called the told them it was totally unjustified and they refunded it as a good will gesture!
so give them a call stand your ground and im sure they will refund you.
    good luck.

i've rung up in the past and had charges refunded. they're happy to do it as a one off thing.

You only handed the letter in on the 27/01/2007. This gives the bank up until 08/03/2007 to deliver all your statements. They are within their 40 day limit until this time, and you can't make any complaints till then. It is normal to receive statements in different bundles.

The Limitations Act allows you to claim for 6 years from the first point of contact with the bank regarding these charges. You can only claim charges from 27/01/2001.

Do not be tempted at any stage to claim on an estimated amount. If you have to issue a court claim, you will have to provide proof of the charges you are claiming for. If you estimate these, you will not have any proof.

I think that paying off £4037 from your debts for the sake of writing a few letters is well worth bothering about.

Thanks for that. To be honest thats why I haven't got shirty with them yet. I am giving them the 40 days, just amazes me how they can find so many different excuses for one issue!!

The claim will go from the day I receive all the statements (hopefully by the 8/3 like you say) back 6 years to that date (so to 8/3/2001).

Looking forward to it. In Oct/Nov last year I was charged £402 in one month (dont ask, I dont know either  ) but if thats one months worth, whats 6 years gonna be like?

Your first contact was on the 27/01, so you can claim for six years from this date.
