  • I am reclaiming approx. £3 500 from Nat West in bank charges. I sent the usual letters and not having received a satisfacory response ( no offers, just the standard we'll look into it reply ) I initiated court proceedings in the small claims court on Jan 31. Yesterday I received a letter from Nat West offering to settle for the full amount of charges I am reclaiming - ie £3500. In my court claim I am claiming a futher £1000 in interest plus £120 for court charges. What do I do ? Forgo the interest and court charge and take the £3500 ? Or do I reject the offer and hold out for the interest - I believe that now the matter is with the courts I am legally entitled to the interest if I win. Central to all this is the fact that I received the bank's offer AFTER I had initiated court proceedings. I can't make my mind up whether Nat West is trying to get out of paying the interest, wheter they are messing with my head or whether they are in fact being reasonable. Am I opening up a can of worms by rejecting their offer ?

    I believe that now the matter is with the courts I am legally entitled to the interest if I win.

    NatWest had their chance to settle in full without interest before you filed the claim They didn't meet the deadline so it's tough on the bank. You are entitled to keep going with the claim. You could write to them and let them know their offer is unfortunately too late and now interest and court fees are due.

    .....for a returned dd? i had a new direct debit come out of my acc last week and i completely forgot (as you do) and they have charged me £40! i wouldnt mind but the dd was only for £10. :confused:
    It's been £38 for some time, they must have put it up again to fund all the rebates their having to give.

    Nat West under my belt £4532, LTSB, £7300, Barclays, £2300, First Bank of America, £3200. Rates overcharge £1700. Just working on Egg

    oh my god!!!
    just got in from work and found a leter from natwest.Expecting the worse i opened it and am still in shock!!!
    They are paying my charges!!! £4037!!!!!!!!!!!!!!!! (claimed £4376 and even offred to take less!)

    One last question ... in the letter they state that they will pay the cash into my account but if i ring and ask do you think they will give me a cheque instead?

    Do you think I could ask for a complete breakdown of the charges and how much of each charge goes where when I write my second letter so I can see what they say.

    You could certainly ask, but as the answer is germaine to the whole reason why the banks are settling in that they do not want anyone to know just how much it REALLY costs them to deal with a refered item. The whole slant of the law is that the charges are unfair because they are disproportionate to the banks costs.
    Having been watching the ever growing tide of sucesses that have appeared here over the last few days, if I were you i'd just stick to this tried and tested formula.

  • Hiya just wondering if anyone can give me some info or if anyone has been in the same situation . We have 2 natwest accounts and we have been sent default notice for both of them , but we are claiming nearly £3500 back off them in unfair charges . If we are successfull we will be able to pay off all we owe them and have quite a bit left over . My question is with our accounts being defaulted on and if they dont close the accounts will we still be able to use the accounts again ? We had the cards taken off us last year and we havent had the time to open new accounts yet but im wondering if anyone has been in the same situation ?

  • If they entered the default after you started you claim, write to them advising the account is in dispute and to enter a default whilst the account is at that status is contrary to the banking code.
  • Hiya thanks for that the account was defaulted before we started the claim , we sent the first letter yesterday and the accout was defaulted on at the beginging of january so do you know if we will still be able to use the accout if we do get a satisfactory offer ?
