    Thank you! That's fine - they prob owe me more than what I owe on the O/D!! I remember as a student I was being charged left, right and centre!!

    I've claimed around £1150 worth of charges from NatWest and they wrote to me offering £800. I am not sure whether to accept or got through Small Claims Court for the full amount. I'd love to hear from someone who's been in my situation and find out about the outcome. Thank you :o

    Ive just submitted online moneyclaim to natwest , Feeling very anxious as 120 pound was a lot to maybe be losing in addition , If i lose..... Just hope i get the money back..... they have only replied to my first letter, saying they were looking into it, ignored the following two.....grrr.....fingers and all crossed!!!

    It's been the same for me. Only got a response from the first letter. Everything else ignored. I know also need to get court proceedings moving. How do i go about it?

    I am a bit nervous as i have never used a chat forum before and am wondering if anyone can give me any advice on this matter. I wrote to Natwest on 2nd January 07 and they sent my statements to me about a week ago. The problem is that one of the parcels was open and i have no way of knowing if any pages are missing since they seem to start at page 115 but i asked for 6 years worth and they do start at Dec 1999.

    They had insufficiently wrapped the statements in thin brown paper which further increases my suspiscion that my request was met with a total lack of care and pure disdain :mad: . It was probably given to a work experience person to do during their lunch hour as some of the pages were also duplicated. It would be nice if they could handle my correspondance with the same greedy Scroogish dilligence that they use to manage my account every month.

    I have written to them explaining that the opened packages and possible incomplete statements are their fault due to lack of care and attention in sending confidential financial documents. I have also asked for them to just send me a list this time of all the fees they have charged me over the 6 years. I would actually prefer this anyway as the statements are about 5 inches thick when put together and it would be useful to have some idea of what i am owed as i have only gone through about a fifth of them. It's quite clear they want to make this process as brain-achingly hard as possible which is dispicable and outrageous seeming as they are supposed to be the moral guardians of our bank accounts and we have every right to know if they have been misling us out of our hard earned cash.

    I have also said that i expect the original £10 statutory fee i sent to cover their administration costs for this as i do not believe that they have satisfactorily responded to my request of 2nd Jan. I just don't know how or when they will respond to this and if i should also say that I am not amending the original 40 day deadline as the matter is still not resolved.

    If there is anything else i need to add to give gravitas to my letter and enforce my belief that they are tampering with my patience and the law, then i would be very grateful.

    I do hope i have posted this email in the right place! If not, please forgive me and point me in the right direction

    The bank does not have to send your charges listed. They have fulfilled their obligation by sending out the statements. You have no legal right to ask them to send your charges out listed in this way.

    You now have to put all the statements in order, and check if any are missing. It may take a while, but you will be able to spot any gaps if you look through them carefully. You may well find that all the statements are there, and you have no cause for complaint. If any statements are missing, then you have grounds for complaint. In this case, write and ask for the missing statements.

  • Thank you for your help... am pleased to be part of this backlash against these money-grabbing corporate monoliths. It's great to know that i have somewhere to go when i need a question answered. I know i have a long slog ahead but hopefully, it will be worth it

    I had my claim at mco acknowledged and recieved two sheets of paper from the court (mco) all it say is

    The defendant now has 28 days from the date of service of the claim form to file a defence.

    Page 2 response pack stating that cobbets intends to defend all of this claim

    I'm just wondering on the mco website do I now have to put a dot in the second option that says The defendant admits that all the money is owed
    (Judgment by Admission)
    If the defendant has given a new address on the form of admission to which correspondence should be sent, update the defendant's details within the following Judgment request.

    and update the address for cobbets or do I wait for the QA from the courts first.

    You don't have to do anything at this stage, just sit and wait to see how Natwest are going to respond to the claim.
