    Thought I would try and call the customer services department dealing with my claim, I have read other posts where this has been a success.

    They said they would call me back, which they did, they told me they would look at my claim but could not tell me when, they said they would need to go through my claim to ensure it was correct. I did advise them that it was based on the information they had supplied to me.

    I explained that I had innitially given them 14 days to reply, which they did asking me to wait longer, then another 7 days ( which was up last Thursday). I said I feel these time scales are fair and was hoping to resolve the matter with them. The man who said he was called John, said he could not give me any indicator of a timescale.

    I explained that I would be left with no alternative but to commence legal proceedings for the recovery of my money, and would request interest and costs be paid as well. I said I just thought the bank may wish to settle this matter, with a longstanding customer out side of legal proceedings.

    The man then became a bit difficult, he said if thats the action I wanted to take that was up to me, but that the F.S.A give them 56 days to respond and that my time scales were not reasonable, he bid me good day and put the phone down sharpish.

    Looks like I will have to do the M.C.O.L thing ( when I get paid on Wed), at least I can say I have made every reasonable attempt to settle this matter, prior to innitiating court proceedings.

    Sorry if this has already been posted but only started using this couple of weeks ago and still trying to find way around! I have sent letter to Nat West claiming charges in excess of 2000 and separately listed the interest they have charged, in excess of 400. I have been working out the interest, on the moneysaver calculater, in case I need to go ahead with claim through court - is the interest the bank have charged me classed as "a charge" which I can claim back or do I just go for charges with interest through the court?
    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA
  • Hi, as a new member I am trying to help my son-inlaw reclaim Nat West bank charges on his now closed business account. Has anyone achieved success in this area?

    You can issue the court claim in your name only if you like.

    The interest the bank charges you for being overdrawn cannot be claimed. Only the interest charged on any bank charges that have taken you over your overdraft limit can be reclaimed. Working this out accurately can be extremely difficult. Your figures have to be accurate because the bank may at any stage challenge the validity of your claim.

    Many people have had successes against Natwest. Both consumer, and business account holders. If you follow the steps carefully, you stand an excellent chance of success.

    Yes but the account is still open for the moment - when the time is right......

    I originally asked for £700 on Dec 15 but when I checked my statements it was actually £760. As they hadn't replied with anything meaningful I filed MCOL on 18th Jan plus interest and court fee. Still no response but in the meantime they have offered the original £700. Since they are obviously running two to three weeks behind the game I'll let them sweat a while. They only have a week to contest the claim.

    Just to clarify the interest that can be claimed in goes to court - I have used the MoneySaver calculater and put in EACH individual charge with the date the charge was made - is this correct and do I now just add this to the charges as part of the claim.

    Nat West's time is up at the end of this week so am thinking of sending the without prejudice template letter offering to settle - if they wont - this wont then affect my being able to proceed through the small claims will it?

    The interest worked out on the calculator in Martins article is the 8% interest you claim in court. When/if you issue a court claim, you will put your charges, then this interest seperately in the particulars of claim, then your total claim will be the total of both these.

    Offering to make a deal will not affect any court claim if you have to go that far.
