You can try, but you will probably find you can't proceed. Banks are well known for filing a defence at the very last second!!0 -

I currently have a student account and a current plus account with natwest, both of which have overdrafts. I have had about £400 worth of charges, with charges on my student account being £38 a time, and would obviously like to claim them back. however, I am a little worried after reading that banks may close your account as i cant afford to pay off my overdraft and cant open a new student account as you can only have one. is it worth trying to reclaim the charges if there is the chance of my account being closed as this may leave me in a bigger financial mess? if anyone could help me with this i would be grateful.0

Well, I read up on this and got myself prepared for the long battle ahead. I already had my statements going back 6 years so it was just a matter of listing the charges and calculating the interest. I sent my letter to Natwest customer relations claiming £628 plus £134 interest on 17/01/07. On the 22/01/07 I got a letter defending their position and the validity of their charges but as a gesture of goodwill they would settle for £628. They aren't going to pay the interest I claimed. To be honest, I'm pretty happy with that and have replied saying as much. Was amazed at how quickly it happened and with absolutely no fuss at all. I only sent one letter and got my result in less than a week!0

Only you can decide. No one can say for sure whether your account will be closed or not. It has happened and could happen to you, so you need to be aware.
If there's no possibility of you repaying your overdraft, maybe it's better to wait until you're in a position to do so before you claim.0 -
Just wondered....has anybody that has claimed with an overdraft been told they have to pay the whole amount back?
Thanks in advance!0 -

Cheers mate. I don't know if I am the exception to the rule but I can't believe how easy it was. One letter is all it took.0 -
