    Well folks,

    Some of you following my story may have read that I've got to the stage where the court case is pending, and Cobbett's (their solicitors) have made me an offer of 50%.

    I've declined the offer and awaited the court case.

    Letter from court today, (addressed to NatWest), stating:

    "The Court, of its own motion, is considering striking out the defence in this action as an abuse of process." italics mine

    "The basis for this is the fact [AND THIS IS THE BIG ONE FOLKS], that the Defendant is settling all claims of this nature where claimants are seeking the reimbursement of bank charges, with no claims proceeding to a contested hearing." italics mine

    WOW.

    Feel less nervous now?

    Cobbett's can object, and they have a week or so to do it. However the objection must contain a schedule of all claims which HAVE gone to court, otherwise the court thinks its time is being wasted.

    "In the absence of such objections....a judgement will be entered for the amount claimed by the Claimant, plus costs".

    Keep going folks.

    Now it's not just customers who are fed up!:mad:

    I've seen a few cases of judges doing this. They must be so annoyed with all the claims clogging up the courts that are not being defended.

    Natwest won just one case in court. This is against what now must be thousands they've paid out without a hearing.

    Let's hope this catches on at more courts.

    does this mean then that we are more likely going to get some money back without having to go down the court route?

    Hi all.well we are about to grab the bull by the horns , and request our statements so we can work out what they've stolen from us over the years!!
    Quick question , I have just sat and read this whole thread from beginning to this post , lol , so i do apologise if i've missed this.
    I have read about this "right of apropriation" ?? Does this mean that the banks should not be taking charges from benefits?? We get child benefit and wftc's , and im pretty sure that charges have been taken fron these....if so , is that something i should point out when i write the letter reclaiming charges??

    Right of appropriation does not only apply to benefits. It can be used for any money you pay into the bank. If you see the post that mentioned this, there is a link that holds more information about benefits.

    Don't mention any of this in your letters reclaiming your bank charges. This is a different matter. Use the template letters in Martins article to reclaim your charges.

  • Having just been charged another £60 referral fee, and the Natwest refusing to reimburse us after a very polite phonecall, my husband has decided that its time we started a claim!!
    He did tell me to leave it alone, until i successfully re claimed £2083 from Hsbc, and then he said "lets do it"!!

    Hand delivered a letter and £5 charge for statements that Natwest told us they would charge for them, and got a reciept,two weeks ago.
    When i checked online banking later that day i noticed they had refunded the £5 to our account.

    We have since heard nothing from them, and i was just wondering how long it s been taking for them to send out statements? obviously i know they have 40 days,just wondered if they were quick or not?!:confused:

    Well , we've started the ball rolling. Just come back from our branch , where we handed them the letter requesting statements. I cant think we'd be the first in our branch to do this , but the look on the chaps face was an absolute picture !! , and me stood there with a big grin on my face , Lol.
    Interestingly , they wouldnt take money for a charge??
    Now i dont know if i'm looking forward to seeing how much they've had from us , or dreading it!!

    Hi
    I need to do the M.C.O.L now as time has passed.

    I made the mistake of asking for interest with my first 2 letters.

    Can you tell me, for the M.C.O.L, can I fill in the spreadsheet again, the bank have added further charges to my account, which would make the total I would be asking for a bit higher.

    Is it better to just ask for the original ammount or add the new charges as well??

    Not sure how the court would view this?
