Don't do anything at this stage. Just sit and wait to see how the bank responds. If they enter a defence, the court will write to you.

So how long do they have to enter a defence because there 14 days are up on m.c.o. is there a time limit to this stage ?

    thamks again

I've got a few more days before the 14 days ran out and yes this letter was from Customer Relations in Borehamwood

The Customer Relations dept handles all these claims so best to address any addtional correspondence to them (I'm willing to bet your letter was signed 'Mr Higley!!').

Hopefully you'll get a similar response as I did, but if not crack on!

    Good luck :)

PS. My girlfriend's friend works at NatWest house (not Customer Relations though) and said they (Cust Rels) are seriously stretched and getting pretty p'd off with us lot - excellent! :D

    Hi

I just got a response from Natwest from my first letter I sent them, this is what they said

Now what should I do now, do I send the second letter or should I leave it till I get another reply and if I send the second letter do I send it to where I got this letter from and not the Branch I'm with.

I'll be glad for any feedback regarding this.
I had exactly the same letter letter today (Otherwise known as a Higley) I have sent the second letter, also by recorded delivery, to my branch but I have also sent an acknoledgement and copy second letter to Mr Higley at Borehamwood.
As has been said on this site many times, and I agree, stick to your own timetable, do not let the bank dictate the timescale. As I understand it the whole reason for going about it as Martin et al suggest is that you, by giving the notice periods as set out in the template letters are being shown to be both reasonable in giving the bank a fair time to respond, and firm in sticking to your timetable. If you ever get to court this will be in your favour.
Whoever said "it's only money" had too much of it!;)

Nat West under my belt £4532, LTSB, £7300, Barclays, £2300, First Bank of America, £3200. Rates overcharge £1700. Just working on Egg

Natwest have so far offered £264 at the first stage, £1300 at the letter before action stage, and £1700 when the court papers were first issued. This was all on a claim for £2600.

All of these offers have been turned down. I am now preparing the next stage of the court process.

Don't know what i did wrong - I never got offered anything at all. Just got a letter from their customer relations asking me to bear with them while they investigated it. Now in the Money Claim process and they've just filed a defence..........

You haven't done anything wrong. The way the banks are treating individual claims differently looks set to be one of lifes mysteries. One person could claim for £3000 and be paid in full after one letter. Another person claiming for the same amount will have to go to a court claim to get paid.

Just carry on your claim. Your chances of success are excellent.

  • The charge for the Advantage Gold is set out when you take the account. At the end of the day a bank is a business and need to make money. They do need to charge for services somewhere!

The monthly charge for an Advantage Gold account is nothing to do with bank charges. This cannot be reclaimed. If there are charges on top of this for being over your overdraft limit, these can be reclaimed.

Try phoning them again, or go into your branch, but this time don't argue (this is very important). Point out to them that you are aware this charge is unlawful, and if they wont refund this charge, you will start a proper claim for it. If it is only one charge, I'm surprised they haven't refunded it straight away as a 'gesture of goodwill'.

Thats ahppned to me before - I rang and said I couldn't afford the charges that month and they refunded me without question!

Yes, a business is a business, but perhaps they need to be a bit more forthcoming about how their charges are made up.

I resent being charged £30 when in fact all it takes is 1 x envelope .. 1 x 1st Class stamp .. 1 x A4 piece of paper and 30 seconds for someone to press the 'Enter' key on a pc to make it print off a pre-defined charges template :rotfl:
    Nat West = CONQUERED: 10/02/07 .. PAID UP IN FULL .. OVER £2800!! :j

Many banks don't even bother sending a seperate letter anymore, they just include a charges summary with the monthly statement.

Those that do send a letter, in the vast majority of cases, they are produced by an automated system, no user interaction required.
